PURPOSE OF AUDIT:
Comprehensive Audit
NOTICE OF VIOLATION(S) (citation and explanation):
Permit Condition Number 11 a. states that "the C&D facility shall accept only those solid wastes which
it is permitted to receive." Two closed drums were noted during this inspection. At least one of the
drums contained approximately a gallon of liquid or hazardous waste inside. Remove drums from the
working face and dispose at a facility permitted to receive the waste. Documentation will be required
to indicate that the barrel holding the liquid or hazardous waste has been disposed of properly.
Mail copies of receipts indicating proper disposal to Dennis E. Shackelford, 225 Green Street,
Fayetteville, NC 28301. This needs to be completed within 10 days of receipt of this notice.

2. 15A NCAC 13B .0505 (10)(e) states that `Barrels and drums shall not be disposed of unless they are
empty and perforated sufficiently to ensure that no liquid or hazardous waste is contained therein." The
drums had closed ends with only one spout. Drums delivered to the unit need to be inspected to
determine that compliance with this rule is met.
3. 15A NCAC 13B .0505(11)(a) states that "A site shall only accept those solid waste it is permitted to
receive. The landfill operator shall notify the Division within 24 hours of attempted disposal of any
waste the landfill is not permitted to receive, including waste from outside the area the landfill is
permitted to serve." Corrective actions need to be underway immediately when waste is found that the
landfill is not permitted to receive.
4. 15A NCAC 13B .0505(11)(b) states that " No hazardous or liquid waste shall be accepted or disposed of
in a sanitary landfill." One of the drums contained a liquid.
5. Permit Condition Number 12 a. states that "C&D operational soil cover of at least six inches shall be
placed at least once per week or when the active area reachesl/2 acre in size or more often as
necessitated by the nature of the waste so as to prevent the site from becoming a visual nuisance and to
prevent fire, windblown materials, vectors or water infiltration." The unit has not been covered as
required by this rule. The exposed waste that has not been covered weekly needs to be provided with a
minimum of six inches of soil cover. The waste needs to be covered within 30 days of receipt of this
notice.
6. 15A NCAC 13B .0566 (3) states that "solid waste shall be restricted to the smallest area feasible and compacted
as densely as practical into cells". The LCID unit is not being compacted into cells and is not being kept to the
smallest area feasible.
7. 15A NCAC 13B .0566(4) states that "adequate soil cover shall be applied monthly, or when the active area
reaches one acre in size, whichever occurs first'. The LCID unit has not been covered as required by this rule.
The area exposed was approximately 500 feet long and the entire vertical face was exposed. Adequate soil cover
needs to be completed on all of the exposed waste within 30 days of receipt of this notice.
You are hereby advised that, pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $5,000 per day may be assessed for each
violation of the Solid Waste Statute or Regulations. If the violation(s) noted here continue, you may be subject to enforcement actions
including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such
further relief as,may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

OTHER COMMENTS /SUGGESTIONS:
1. The wind blown waste along the access road to the C&D unit needs to be collected and returned to the unit for
proper disposal.

2. Permit Condition Number 2 states that "this permit will be subject to review every five years, on or before
February 3, 2003. Modifications to the facility may be required in accordance with rules in effect at the time of
review". Submit within 30 days of receipt of this notice an application to extend the permit or close the
facility. Permit correspondence should be mailed to Mr. Jim Barber, Permitting Branch Head, 401
