Donna and Sherri, I am emailing you regarding Orbit Energy's plans to install retrofits at the Orbit Energy Charlotte facility located at 600 Johnson Road, Charlotte, NC. These facility retrofits are necessary for the facility to comply the terms of the Permit to Operate portion of Solid Waste Permit issued by NCDEQ. We met locally on July 13, 2018 with the Mecklenburg County LUESA divisions to outline (1) the plans for the retrofits to be installed, and (2) to explain how the retrofits would bring the facility into compliance with the conditions of the facility's operational permits. In attendance at that meeting was Joe Hack who suggested that we provide an outline of the facility retrofits to our State -level regulators as well. I am writing you now as a follow-up to Joe's suggestion. I would like to either meet with you in person to discuss and present these facility retrofits or conduct a virtual meeting via GoToMeeting (or similar platform) to walk you through the upgrades. Please advise if you and your team would be available any of the following days for me to meet with you: Thursday, August 2, 2018 at 2:00, 3:00 or 4:OOpm; Friday, August 3, 2018 all day except 2:00-3:OOpm; Monday, August 6, 2018 all day except 11:00 — noon; or Tuesday, August 7, 2018 - morning Ultimately, the facility retrofits are aimed at allowing us to comply with the terms of the Solid Waste Permit and to formally convert the Permit to Construct to a Permit to Operate when the facility is ready to begin ramp -up later this fall. The overall digestion process outlined in the September 23, 2014 application for the facility's Solid Waste Permit will remain the same but with a few pieces of replacement equipment in the reception building to do so in compliance with our Permit to Operate conditions. Ultimately, we are not seeking increase the volumes of waste processed at the facility nor to receive any types of waste that were not already approved in the Permit; rather, we are seeking to retrofit the facility as currently constructed to satisfy the spill and odor control conditions in the Solid Waste permit and more efficiently and effectively process waste at the facility. The original of the attached is being delivered to your office via overnight delivery service. I note that the facility is not currently accepting any further feedstock as we work to retrofit the facility with upgrades necessary to comply with the Solid Waste Permit issued for the site. We have terminated our contract with Auspark, LLC on the construction of the facility and have engaged ES Engineering Services to operate the facility and to design and install with the facility retrofits. We have made a presentation to the local Mecklenburg County officials regarding the anticipated facility retrofits. Joe Hack was the senior -most regulator from Mecklenburg County Solid Waste in attendance. With whom at NCDEQ should I discuss the planned facility retrofits? Ultimately, we are retrofitting exclusively to process feedstock volumes received in compliance with the currently issued permits for the site; we are seeking neither to increase the volumes received nor the types of feedstock accepted at the facility. We want to make sure that we have provided NCDEQ with sufficient information regarding replacement equipment that we will be installing in the reception building at the facility to process food waste and how that will affect our overall process at the facility.
