Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Cleveland County. 3. The Self-McNeilly facility accepts an average of 318 tons per day. 4. The C&D Landfill accepts an average of 195 tons per day. Operations Inspection of the MSW Landfill Unit: 5. The facility is currently working in Phase 3. 6. Edge of liner markers were observed. Edge of waste is placed no closer than four feet from the edge of liner. 7. The working face was small and compact. 8. No unacceptable waste observed on the working face. 9. All access roads were maintained in good condition. 10. The facility utilizes soil and spray -applied Mortar Coating (SMC) for daily cover. 11. Windblown waste was being picked up during the inspection. C&D Landfill Unit 12. Edge of liner markers were observed. Edge of waste is placed no closer than four feet from the edge of liner. 13. A Republic Services truck was observed backing up to the working face and dumping a load of pallets. Mr. Wright called the scale house to stop the driver and facility staff separated the pile of pallets to be disposed of in the T&P area. 14. All access roads were maintained in good condition. 15. Working face less than'/2 acre in size. 16. The facility utilizes soil for cover which is applied weekly. 17. On March 13, 2024, and March 26, 2024, site inspections were performed in response to a report of water flowing through waste on the north side of the landfill. During these inspections water was observed flowing through an eroded ditch exposing waste for approximately 150 feet and four leachate seeps were discovered. On May 24, 2024, a Leachate Seep and Eroded Diversion Repair Plan (FID 1847766) was submitted by Garrett & Moore to the Section for review. During the inspection conducted on June 20, 2024, no water was observed flowing through the eroded ditch. White Goods & Scrap Metal Collection Area 18. White goods and scrap metal are collected from the public at each of the County's nine convenience centers. CFC's are removed from all white goods by Smart Air at the convenience centers. Cleveland County then hauls the white goods and scrap metal to a staging area located NW of the two leachate above ground holding tanks. 19. All metal is placed on a concrete pad. Morris Metal in Kings Mountain hauls the metal to their facility for processing. 20. The area was well maintained. Page 2 of 4 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Scrap Tires 21. Scrap tires are collected and stored in U.S. Tire semi -trailers. 22. The facility accepted 270 tons and 247.56 tons were removed for disposal by U.S. Tire during the period of 5/l/2023 to 6/30/2023 and accepted 1,433.64 tons and 1,417.55 tons were removed during the period of 7/1/2023 to 6/24/2024. 23. The area was well maintained. Treatment of Processing Area 24. Pallets and yard waste debris are maintained in separate stockpiles. 25. The area was well maintained. Records Review 26. Current copy of permit and operational plan were on file. 27. Reviewed 2nd semi-annual groundwater monitoring report for 2023, 1 st semi-annual groundwater monitoring report for 2024. Leachate monitoring is performed semi-annually with their groundwater monitoring. 28. Reviewed methane monitoring reports for 1st Quarter 2023, 2nd Quarter 2023, 3' Quarter 2023, 4t' Quarter 2023, 1st Quarter 2024 and 2nd Quarter 2024. 29. Random inspection reports were reviewed. Facility staff perform an average of three (3) random inspections each day at MSW and CDLF. Screening performed with good frequency. Good documentation of observed unacceptable waste streams and final disposition of this waste. Records reviewed were from Jan. 1, 2024 - June 19, 2024, for the MSW and Jan. 1, 2024 - June 19, 2024, for the C&D. 30. Leachate is discharged by a force main to the City of Shelby WWTP. It is pumped via force main eight (8) times every twenty-four (24) hours for a duration of thirty (30) minutes each time. 31.
