David Powell with the Solid Waste Section (Section) visiting the site to conduct a comprehensive inspection of the Yard Waste Notification. The site has an all-weather road, good access and is gated. The site is not open to the public for dumping of any waste. Mr. Stephen uses the site to sort and stage land clearing waste from his business. No yard trash is brought onsite. Wood waste goes out to be treated and dyed, such as Old Castle, for selling to homeowners and landscapers. Once the mulch is dye/treated at another site, some is brought back to sell to landscapers/homeowners etc. Some are sold as whole logs to mills, some as firewood and some to boiler fuel, such as Inviva or West Rock. The site is less than 2 acres. Other mulch and soil products are available for sale to public upfront. Although it’s not required, four corner Edge of Waste (EOW) markers marking the notification area, with respect to buffers, would be helpful to Section staff and onsite staff. Section staff can easily measure buffers and onsite staff will have an outline of where it’s approved for waste to be staged. Suggest tall white PVC pipe but these should be placed to meet buffers for a Yard Waste Notification. Notification area. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. Mr. Stephen has his own equipment for processing wood onsite. Much of what’s onsite is sold and waiting to be picked up. Waste is sorted into different use piles to be mulched or logs to be sold. Older waste in rear of property along sides, should be sorted and utilized according to rule soon. Based on Mr. Stephens indication of the property lines, and confirming on Site Locator Tool online, the buffers are being met, although maybe close on the sides in couple areas. Mr. Farr is actively cleaning some waste on the edge of buffers on each side. All yard waste should meet property line buffers of 50 ft from property lines. Previous inspection accidentally stated 100 ft, but 50 is correct for small type 1 YWN. Although not a current dwelling, there is an office located within 200 ft from composting area onsite to the east. Caution and separation should be given, as much as possible, with the use of grinder operation. This would be prudent for safety and minimizing any noise potential, which may lead to complaints in future. Also be sure and keep separation from piles/windrows and access around them for firefighting. Be sure to remove the older mulch spread out in the working area from time to time. Any water that comes into contact with the mulch is considered leachate and should be managed onsite and not allowed to runoff. Keep documentation of waste received and where waste is taken for future reference. Buffer on west side, delayed cleaning due to buzzard nest with babies past logs inside vegetation and against chip piles. Please follow through once the babies are gone, soon. Please inform Mr. Powell if the property changes hands. The YWN paperwork will need to be redone. If YWN is to be closed, all waste down to clean soil should be removed according to rules and an inspection done to verify and then the site can be closed. If a new owner wishes to operate activities which warrant a YWN then they will need to resubmit a notification with appropriate paperwork. Please follow through with EOW markers, cleaning and marking property line buffer. To allow continued storage in buffer would be in violation. Please contact me if you have any questions or concerns regarding this inspection report. ________________________________________ Phone: 919 – 280 – 5135 _ David Powell Environmental Senior Specialist Regional Representative Sent on: 6/25/2024 X Email Hand delivery US Mail Certified No. [ _] Copies: Andrew Hammonds, Filed Operations Branch Head - Solid Waste Section
