Dear Mr. Hodges, Addington Environmental, Inc. has submitted a Site Application and Facility Plan for the East Carolina Regional Landfill located in Bertie County, North Carolina (existing permit number 08-03). The owner or operator proposes expanding the landfill facility in order to expand the MSWLF unit boundary approved in accordance with Subparagraph (a)(1) of Rule .1618. A site study must be submitted pursuant to Rule .1603 (a)(1)(B) of the NC Solid Waste Management Rules (15A NCAC 13B .1600) and subsequently, an application for a permit to construct as set forth in Paragraph (a) of Rule .1617. The site study requirements are found in Rule .1618, Site Study for MSWLF Facilities. The Solid Waste Section (Section) is performing a technical review of the site application submitted by HHN&T. The section hydrogeologist will review the Site Hydrogeologic Report section of the Site Study and will request any additional information under separate cover. This engineering review evaluates the East Carolina municipal solid waste landfill site application according to the NC Solid Waste Management Rules, 15A NCAC 13B .1618. Based on its preliminary review, the Section requests the following information. In accordance with rule .1618(c)(5)(A)(ii), please provide documentation of the public notice given for the public meeting(s). 2. In accordance with rule .1618(c)(5)(A)(iii), please provide the Section with any written material received, used or distributed at the meeting, that we do not currently have. (i.e. it is not necessary to submit another copy of the Site Application) 3. With respect to the facility development plan, please describe why this property is being brought into the facility, and what effect the redesign has with relation to the originally approved facility plan, particularly with respect to cell design and capacity. Addington Environmental and East Carolina Regional landfill must also meet the requirements of rule . 161 8(c)(5)(A)(iv), by maintaining a copy of the record at the local library. Revisions to the site study should be clearly identified with a revision date in either a footer or a header. It is not necessary to submit five copies of revisions or facility drawings, at this time. Two copies will suffice. When the site study is finalized and there are no more changes, then a total of five copies will be needed. These comments are intended to expedite the review of the referenced application, and in no way do they restrict the Section's right to request additional information following the technical review process. As we begin the cleanup, landfill volumes will undoubtedly increase to unestimated quantities. In order to assist the County in managing this disaster, East Carolina Regional MSW Landfill and the Bertie County Board of Commissioners request your immediate help on the following: A. Immediately suspend the daily landfill volume cap and the annual landfill volume cap for 1999. We may further request this be suspended beyond year-end, but that request will come at the appropriate time if necessary. B. Assist East Carolina Regional MSW Landfill with the redesign/expansion application which was approved by the Board of Commissioners and submitted to the Division. This application must be approved prior to the facility submitting a Phase III Construction Permit application for the next cell. We anticipate East Carolina Regional MSW Landfill will be required to construct that cell much sooner than originally planned to accommodate the anticipated waste.
