Permit expires November 7, 2024. Renewal application being created currently. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 ADDITIONAL COMMENTS 1. Section staff met onsite with Interim Manager Lane Bailey and Public Utilities Director Robert Burns for a routine comprehensive inspection. This facility is a land clearing and inert debris (LCID) landfill owned and operated by the City of Hamlet, not open to the public. Mr. Stubbs and Mr. Christian are no longer with City of Hamlet. Mr. Powell shared the last approved Permit to Operate, renewal application, and 3/2022 inspection report with Mr. Bailey and Mr. Brown via email. The permit will expire November 7, 2024, and it is already within the 6 months renewal timeframe, so a renewal application should be submitted as soon as possible. Mr. Powell shared newest LCID rules and contact information via email after inspection for Section Permitting Engineer John Nguyen - (919) 707-8183 or john.nguyen@deq.nc.gov. 2. The site is open only to City of Hamlet use and is behind a locked gate. Current signage needs to be updated to meet current rules specifically. Signage has most info but should have entire permit number, waste types accepted for LCIDs, enough emergency contact information that someone can contact City personnel after hours should there be a fire or emergency. 15A NCAC 13B .0566 (14) A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site. Section staff walked/rode the LCID, while city staff were actively operating the working face with waste dumping operations. The working face was small and compact. The side slopes were less than 3:1. Cover was sufficient in most areas, however, there was some exposed waste along older areas and some side slopes. Older phases or cells, which will not have waste for 3 months or more should be covered with at least 12 inches of soil cover. Be sure to cover all waste when waste reaches one acre in size or after every thirty days, whichever is first. 15A NCAC 13B .0566 (3) All waste shall be covered with no less than six inches of soil monthly, or when the working face reaches one acre in size, whichever occurs first. Any soils used for cover at the site shall meet unrestricted use standards for soils as defined in G.S. 130A-310.65. 15A NCAC 13B .0566 (4) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. However, there were some ruts and areas that need addressing to continue to remain passable. In addition, a perimeter road around the waste disposal area was supposed to have been installed. Please be sure and make it so roads go around perimeter of cells for access and firefighting should it be needed. 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. Perimeter road needs to be installed after checking waste placement, buffers and EOW markers. 6. EOW (Edge of Waste) markers were only visible on one corner. Previous inspection instructed City of Hamlet to have EOW markers checked to be sure they marked correct placement in regard to property buffer, especially south side slope along CSX Railroad, but also for correct placement with regards to waste disposal and what is approved in the application/operations plan. Section staff attempted, during the last inspection, to verify with laser range finder while onsite, but vegetation prevented a complete confirmation. Vegetation has overtaken surrounding areas and should be mowed. Suggest having consultant/engineer/surveyor look at approved documents and install permanent EOW markers, marking the proper limits of disposal. If any waste is beyond those limits, pull it back inside the correct area, and then plan for a perimeter road around the EOW, with new EOW markers installed. Documentation should be created and kept in file to show this has been met. Also, I a sediment trap that says it is to be cleaned and reestablished on one of the maps on the SE corner that’s disappeared onsite due to vegetation (page 26 of 95 on 2/26/2020 application). Maybe it’s there, maybe it’s not???? We need to find out and be sure it meets rule as well. Onsite discussions consisted of these items but mainly submitting permit renewal after speaking with Section permitting. Also, adding to road and continue filling low areas. In addition, confirming the proper placement of the EOW markers on the side along the railroad property line. That should be done, and confirmation emailed to Mr. Powell. Main goal concern is to ensure, waste disposal is in correct areas, proper placement of the EOW markers, with respect to buffers and a new perimeter road installed, all according to rule. Mowing of vegetation in some areas but mostly surrounding LCID is needed as well. 8. Corrective measures are necessary. A follow-up compliance inspection may be conducted by Solid Waste Section Staff within about 60 days’ receipt of this inspection report. All corrective actions should be addressed by that timeframe. Failure to meet the conditions for compliance may result in further Compliance Actions.
