Renewal YWN submitted on May 15, 2024. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTED VIOLATIONS A. 15A NCAC 13B .1406 (6), "A site shall only accept those solid wastes that it is permitted to receive." UNRESOLVED: At the time of this inspection, the unacceptable wastes that were observed in the June 2023 inspection report had been removed; however, new unacceptable wastes were identified. New construction and demolition waste was observed in the northwestern portion of the site. Ms. Thompson spoke with Mr. Eaton via telephone following the inspection. Mr. Eaton stated that he would ensure that the waste was removed and would provide the Section with photographs. B. 15A NCAC 1313.1401(a), "No person shall construct, operate, expand, or modify a facility that produces compost from solid waste or solid waste co -composted with other waste unless it has a currently valid permit issued by the Division for a solid waste compost facility, except as provided in Rule .1402(f) and (g) of this Section." and 15A NCAC 13B .1402 (g)(1)(A), "notification to the Division prior to operation and on an annual basis." RESOLVED: The YWN renewal notification was received on May 15, 2024. Page 1 of 3 NORTH CARnLINAD_E Q�� o.n.mm.m m c.w.mmen.i a.i� OBSERVED VIOLATIONS: None: FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility accepts waste from Town of Woodland Groundskeeping activities. No wastes are accepted from the general public. The waste is ground on site then used around the bases of flowers, shrubs, and trees around Woodland. 2. The access road to the facility is being properly managed at this time. 3. Access to the site is controlled by a locking gate, which was locked during thus inspection. An unsecured secondary access point may be located off Chestnut Street, which may be contributing to the dumping of unacceptable wastes in the northwestern portion of the site. 4. Signage is posted at the gate with emergency contact information. 5. A digital photograph of the southern portion of the yard waste area was taken from the gate during the inspection. 6. Corrective actions are required as a result of this inspection report and must be completed within 30 days' receipt of this report. The Solid Waste Section will conduct a follow-up inspection in 30 days to ensure issues noted in this inspection report have been addressed. Please contact me if you have any questions.
