Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. Proper signage was observed at the entrance of the facility. 2. The facility is permitted to receive solid waste generated within Gaston County and the area encompassed by a radius of 100 miles extending from the Gaston County line. 3. The facility accepted an average of 757.77 tons per day from July 2023 - May 2024 at the MSWLF. 4. The facility accepted an average of 359.70 tons per day from July 2023 - May 2024 at the C&DLF. 5. The facility is currently working in Unit 3, Phase 1. 6. The working face was small and manageable, and no unacceptable waste was observed. 7. Edge of liner markers were observed. 8. The facility utilizes soil and spray -applied mortar coating (SMC) as alternative cover. Soil cover is applied at least once a week and more often when deemed appropriate. 9. Facility staff were actively picking up windblown waste. 10. On April 21, 2023, an Intent to Close notification was submitted to the Section indicating the C&DLF on top of the unlined MSWLF would cease waste receipt operations by July 1, 2023. It. During the inspection permanent vegetation was observed on the C&DLF. White Goods & Scran Metal Collection Area 12. The area is well maintained. 13. White goods are staged upright on a concrete pad. 14. CFC's are removed from all white goods by Smart Air of Shelby, NC. 15. Scrap metal is collected by Web Metal for recycling. Scrap Tires 16. Scrap tires are collected and stored in US Tire semi -trailers. 17. The facility had two trailers on -site and facility staff lace the tires in the trailers. 18. The area is well maintained. 19. US Tire collected 2,334.32 tons from July 2023 to April 2024. Electronics Recycling 20. All electronics are staged by county staff prior to being taken for recycling by ERI. 21. During the inspection observed electronics palletized and wrapped. 22. The area is well maintained. Small Type I Composting 23. Attendant on duty checks all incoming loads. 24. Only yard waste, silvicultural waste, untreated and unpainted wood waste is accepted and ground into mulch. 25. The area was well organized and maintained. 26. A 20-yard roll -off is staged for unacceptable waste. 27. Henson's, Inc. is scheduled to be on -site July 8, 2024, to grind the material. A copy of the current permit and operations plan are maintained in the landfill office. 29. 2nd Semi-annual groundwater monitoring 2022 and 16t Semi-annual groundwater monitoring 2023 were reviewed for Unit II, Phase 1 & 2, 2' Semi-annual groundwater monitoring 2022 and 1st Semi-annual groundwater monitoring 2023 were reviewed for C&D. 30. Reviewed 15t Quarter 2023, 2nd Quarter 2023, 3rd Quarter 2023, and 4th Quarter 2023, and 16t Quarter 2024 methane reports. 30. Waste screening reports were reviewed. Facility staff perform one (1) random inspection each day at the MSW and C&D LF. Good documentation of unacceptable waste pulled out and final disposition noted. Records reviewed were from January 2023 to May 2024.
