DS78-029 on same parcel, next to YWN area - NOTACTIVE. PURPOSE OF SITE VISIT: Routine Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 6 ADDITIONAL COMMENTS 1. Section Staff David Powell met onsite with Mr. Ronnie Seals for a routine comprehensive inspection at the Yard Waste Notification/TDDS. Just south of the YWN area is a Temporary Disaster Debris Site, DS78-029, although it is not currently active and has no waste. Only YWN is currently being used. YWN renewal was submitted 5/17/2024. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. 3. The site has two gates with proper signage. The roads are in good condition and the site was being mowed during inspection. Good job. Large logs are used for traffic control onsite. Simmons grinding is expected to be onsite within the week to begin grinding and hauling previously grinded waste to Robeson County Landfill. First gate. Yard waste area has one large windrow of raw waste and a few windrows of previously grinded waste. Remember the site can only have up to 6,000 cubic yards at any one time of material whether it’s processed or finished product. Site is reaching max size in volume. Simmons and Simmons grinds once a year and periodically hauls, as budget allows. Facility has not been doing time and temperature for composting. Yard waste cannot go out to public unless meet the .1406 rules. 15A NCAC 13B .1402 (e)(6)(A) Small Type 1 facilities shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. 15A NCAC 13B .1406 (11) Compost process at Type 1 and Type 2 facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) for three days and aerated to maintain elevated temperatures. 5. Remember, windrows need to be separated for fire control access. Fire control equipment should be nearby for emergencies. The current windrow is a little large and needs better separation. Suggest separating into smaller windrows with more separation to ensure no spontaneous combustion. Other windrows had good seperation. 15A NCAC 13B .1406 (7)(a) Open burning of solid waste shall be prohibited. (b) Equipment shall be provided to control accidental fires and arrangements made with the local fire protection agency to provide fire-fighting services when needed. (c) Personnel training shall be provided to ensure that all employees are trained in site specific safety, remedial, and corrective action procedures. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 6 6. There was very minimal unacceptable waste visible in the windrow. If need be, staff onsite and staff picking up loads should screen trash / plastic from YW before hauling or loading. If necessary, the site could not accept the load if has unacceptable waste. EOW markers were still in place, however, there was some waste beyond them toward buffer area. Be sure all waste is beyond the 50 ft buffer property line buffer for small type 1 compost site, which is YWNs. 15A NCAC 13B .1402 (e)(1) Type 1 facilities may receive yard and garden waste, silvicultural waste, and untreated and unpainted wood waste. Some minor unapproved waste – trash bags. Please remove to appropriate disposal site. EOW marker, logs for traffic control and large windrow waiting to be round and windrowed.
