This permit shall expire 7 October 2053. Pursuant to NCGS 130A-295.8, the permitee must submit a permit application for any change to the approved engineering plans or for a substantial amendment to the permit. An application for a permit must be prepared in accordance with all applicable statutes and rules in effect on that date. PURPOSE OF SITE VISIT: Partial facility compliance inspection without records review in response to a self-reported fire incident. STATUS OF PAST NOTED VIOLATIONS: None applicable OBSERVED VIOLATIONS: 1) 15A NCAC 13B .0104 (a) states “The owner or occupant of any property, except that exempted as specified in Rule .0103(c) of this Subchapter shall be responsible for the sanitary storage of all solid waste accumulated on the property.” 2) 15A NCAC 13B .0104 (d) states “All solid waste shall be stored using safe and sanitary practices for the preservation of the public health and welfare and the environment that prevents the FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 1604T_INSP_20240605 Page 2 of 4 generation of leachate, the attraction of vectors, the release of odors, and the release of waste or leachate to the environment.” 3) 15A NCAC 13B .0402 (a) states “The owner or operator of a transfer station (site) shall comply with the conditions of the permit issued by the Division. In the event of noncompliance with the permit, the owner or operator shall minimize the release of waste, leachate, or contaminants to the environment, and shall prevent adverse impacts to human health or the environment.” 4) 15A NCAC 13B .0405 (a) states “The owner or operator of a transfer station (site) shall maintain and operate the site in accordance with the operations plan incorporated into the permit by Rule .0404(d) of this Section…” 5) 15A NCAC 13B .0405 (a) (11) states “Site Cleaning and Maintenance: Unless otherwise stated in the site permit, all waste shall be removed from the tipping floor, the truck loading bays, and from behind push walls by the end of each day of operation and disposed of in accordance with this Subchapter. The tipping floor, push walls, and truck loading bays shall be cleaned with a pressure washer no less than once per month. The remaining areas of the site building including side walls and any material storage areas outside of the building shall be cleaned with a pressure washer no less than twice per year. Wash water generated from cleaning waste handling areas shall be contained and treated as leachate. Cleaning and maintenance records shall be maintained and made available to the Division upon written request.” Please see the ADDITIONAL COMMENTS section below for details concerning this inspection. ADDITIONAL COMMENTS: 1) This is a Solid Waste Transfer Facility and is permitted to receive Solid Waste as defined in NCGS 130A- 290(a)(35). 2) Hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, regulated asbestos containing material as defined in 40 CFR 61, PCB waste as defined in 40 CFR 761, infectious waste, animal carcasses, radioactive waste, septage, fluorescent and high-intensity discharged lamps, ashes/incinerated residues, and wastes banned from disposal in North Carolina by NCGS 130A-309.10(f) are prohibited from being accepted at this Facility. 3) This facility is permitted to receive Municipal Solid Waste (MSW), Construction & Demolition Waste (C&D), Scrap Tires, and Yard Waste generated in Carteret, Craven, and Pamlico Counties. 4) All waste, with the exception of scrap tires, which are hauled directly to Central Carolina Tire, permit #43-04 in Cameron NC, is transported to the Coastal Environmental Partnership Subtitle-D Landfill, permit #25-09 in Tuscarora, Craven County, NC. 5) Proper signage including the facility permit number, accepted waste types, banned or excluded items, hours of operation, and the emergency contact number is posted at the facility entrance. 6) The hours of operation are Monday through Friday 7:30 AM to 4:30 PM and Saturday 7:30 AM to 12:00 PM. 7) The facility is secured by means of a locked gate at the facility entrance. The gates was open upon my arrival and facility personnel were on site during this inspection, however, the facility was closed to the public and no waste acceptance or transfer activities occurred while I was present on site. 8) The facility access road is of all-weather construction and is being maintained in overall good condition. 9) MSW and C&D were left on their respective tipping floors overnight. Upon arrival to open the facility, facility personnel discovered the MSW left inside the transfer station was burning. Local fire and EMS were contacted and resources requested to fight the fire. Equipment was used to spread the material while it was being wet down to extinguish the fire. The fire appeared to have been extinguished prior to my arrival and no The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as ma be necessar to achieve com liance with the North Carolina Solid Waste Mana ement Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section 1604T_INSP_20240605 Page 3 of 4 fire crews/equipment were onsite during this inspection. 10) *Moving forward, please ensure that all waste brought on-site is loaded into the transfer trailers in a timely manner and all incoming waste is removed from the facility daily. 11) Portions of the facility walls were damaged by the fire and/or by equipment used in firefighting activities. *Please ensure an inspection of the structure is completed by an engineer trained to certify the structural integrity of the facility before returning to normal operations. 12) Compost staged on-site was used to prevent leachate generating during the firefighting operations from migrating outside the leachate collection area. Compost was placed across the entrance and exit of the trailer loading bay an along the entrance and exit of the concrete turnaround to prevent runoff. *All compost used for leachate management must be disposed as solid waste.
