Dear Mr. Rightmeyer:
Pursuant to North Carolina General Statute (NCGS) 130A-22(a) and to 15A North
Carolina Administrative Code (NCAC) 13B, I conducted an inspection on December 4, 2000,
of the John M Rightmeyer Demolition Landfill, Permit #42A, located Hwy 301 Weldon,
North Carolina. During this inspection, I observed at least two tires, a twenty gallon propane
tank, wire, silt fencing, rebar, painted wood, pipe, a one gallon plastic oil container, a
mattress, box springs, two dead dogs and carpet were going to be covered by the bulldozer
operator.

Burying this type of waste in your demolition landfill is in violation of certain requirements
contained in the North Carolina Solid Waste Management Rules, codified at 15A NCAC 13B,
and the Permit to Operate issued by the Division, specifically:
15A NCAC 13B. 0566 (2) which state that "The facility shall only accept those
solid wastes which it is permitted to receive".
Condition of Permit, Item 4 under GENERAL which states that "This solid waste
disposal site is permitted to receive solid waste as defined as stumps, limbs,
leaves, concrete, brick, wood, and uncontaminated earth. "
Dumping of waste material that it is not permitted to receive has been an ongoing
problem at this facility. I have directed you to remove nonconforming waste material on at
least two previous occasions, which you have done. However it appears that nonconforming
waste material deposited on site is not removed unless I observe it during an inspection.
Based upon the foregoing, you are hereby ordered cease transporting construction,
demolition and other waste material to the site. Any incidental waste material that not land
clearing and inert debris waste material must be removed from the site prior to covering.
Pursuant to NCGS 130A-22(a) and 15A NCAC 13B, Section .0701 - .0707, an
administrative penalty of up to $5,000.00 per day may be assessed for violations of the Solid
Waste Law or Regulations.

John Rightmeyer phoned in response to a warning letter and stated that he has hired Walter
Gibbs to serve as the companies'environmental officer to oversee his operations. Gibbs will
inspect the landfill weekly. Rightmeyer will purchase a new gate and to seal off the other
entrances with logs or concrete.
