Condition of Permit, Item 4 under GENERAL which states that "This solid waste disposal site is permitted to receive solid waste as defined as stumps, limbs, leaves, concrete, brick, wood, and uncontaminated earth. " Dumping of waste material that it is not permitted to receive has been an ongoing problem at this facility. I have directed you to remove nonconforming waste material on at least two previous occasions, which you have done. However it appears that nonconforming waste material deposited on site is not removed unless I observe it during an inspection. Based upon the foregoing, you are hereby ordered cease transporting construction, demolition and other waste material to the site. Any incidental waste material that not land clearing and inert debris waste material must be removed from the site prior to covering. Pursuant to NCGS 130A-22(a) and 15A NCAC 13B, Section .0701 - .0707, an administrative penalty of up to $5,000.00 per day may be assessed for violations of the Solid Waste Law or Regulations.
