The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. David Powell with the Solid Waste Section (Section) returned to the NLCID to follow up on corrective actions
for site to meet closure requirements of 15A NCAC 13B .0567. On April 23, 2024, the landowner, Mr. Pegram emailed Mr. Powell a letter, dated 4/22/24, requesting the closure of N0788 NLCID. Along with this letter, was documentation of eight soil depth test holes, with their GPS coordinates, stamped by Engineer and Land Surveyor Mr. Billy Dees. In addition, photos of each test hole, and a new PLAT map, also stamped by Mr. Dees, were provided. This site had essentially stopped accepting waste prior to 2021 rule change and just needed some corrective actions to officially close. 2. Upon inspection there were survey stakes observed marking new corners outlining deed map work for site meeting buffer. The site was gated and secured with no dumping sign. This NLCID is covered, compacted, and sloped well. A perimeter road is established and seemed to be of all-weather construction. Edge of Waste markers, and additional markers for soil depth testing and survey work, were visible around the NLCID.
Vegetation is established across the NLCID, and all trees and large shrubs removed. No exposed waste was visible during inspection and the NLCID looked good. 3. Site still mines soil nearby. Be mindful of water ponding at bottom elevation of NLCID slopes. Follow Sedimentation and Erosion Control Plan/DEMLR guidance on managing stormwater runoff. 4. A Letter packet will be sent to landowner approving the site to be closed in accordance with 15A NCAC 13B .0567. In addition, the owner of the property where the closed landfill is located must comply with the post-closure care requirements set forth in 15A NCAC 13B .0567(c), post closure care for ten years, which is 2034. This facility cannot accept any waste without receiving a permit from NCDEQ Solid Waste Section, to do so would be a violation of North Carolina Solid Waste Management Rules.
