Permit to Operate will expire April 17, 2025. The Permit Renewal should be submitted to the Section by November 17, 2024. PURPOSE OF SITE VISIT: Compliance Inspection STATUS OF PAST NOTICE OF VIOLATIONS: A. 15A NCAC 13B .0101 (28), "'Inert debris waste' means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead -based paint." CORRECTIVE ACTIONS IN PROGRESS: The inert debris stockpile has been reduced by approximately one-third since the last inspection. The countertop material that is uncovered during the processing is set to the side for proper disposal. The clean inert debris is ground then sent to a landfill for use in their roadway. Efforts must continue to process and remove the inert debris stockpile from the facility. Page 1 of 3 FACILITY COMPLIANCE INSPECTION REPORT D_E Q�� Division of Waste Management NORTH CAROLINA O.paN W Emironm l pu.lily Solid Waste Section B. 15A NCAC 13B .0201 (c), "No solid waste management facility shall be established, operated, maintained, constructed, expanded, or modified without a valid permit issued by the Division for the specified type of activity. It is the responsibility of every owner or operator of a proposed solid waste management facility to apply for a permit for the facility." CORRECTIVE ACTIONS IN PROGRESS: The facility has uncovered and processed approximately 25 percent of the land clearing waste pile has been uncovered and processed. The facility is screening the soil from the land clearing waste then grinding the land clearing waste. The mulch is taken to another facility for dying and sale. The buried waste was to be removed by the end of April per the operator. Efforts to remove and/or process the buried land clearing waste from the T&P area must continue and completed within 60 days receipt of this report. NOTICE OF VIOLATIONS: None. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The facility entrance is fenced and is secured by a locking gate when it is not open for operation. 2. Correct signage is at the entrance of the facility listing the facility name, permit number, emergency contact information as well as materials accepted at the facility. 3. The facility accepts waste Monday through Friday from 0700 to 1800 and Saturday from 0800 to 1500. 4. The Permit, Operations Plan, and training certificates were readily available; however, they were not reviewed during this inspection. 5. 15A NCAC 13B .0564 (7), "The site shall establish and maintain an access road around the waste boundary for access by emergency or fire -fighting vehicles and equipment." and 15A NCAC 13B .0301 (6)(D), "Buffer Requirements ... surrounded by an unused and cleared area of no less than 25 feet to allow access for fire or emergency response vehicles." The facility is in the process of installing an access roadway around the LCID; however, the roadway was constructed with the comingled ground countertop and concrete material. The facility is in the process of removing the countertop material from the roadway. All unacceptable waste must be removed from the LCID within 60 days receipt of the report. Continue to establish and maintain access roads around all areas for fire and emergency response vehicles. 5. A water truck is located at the property and is used to control dust emissions at the facility. 6. An area of standing water, which was a result of recent heavy rains, was observed at the end of the concrete apron for the MWP area. Continue to ensure that the area is graded so that water is shed from the operating area. 7. Minimal windblown waste was observed during this inspection. Continue to ensure that windblown is removed prior to the end of the day. 8. The LCID has been covered with soil. Soil had been staged at the top of the LCID so that the slopes could be reworked to meet the three horizontal to one vertical ratio. 9. Overgrown vegetation was observed on the side slopes of the LCID. Mr. Gustin stated that the LCID would be mown. 10. Ensure that the 100 foot buffer from the property lines are met throughout the facility. 11. Corrective measures are necessary as a result of this inspection. 12.
