PES dispatches First Call Environmental at 0837 CST. c. PES calls the North Carolina Department of the Environment and makes a report. George Bernard takes the report and issues a report number. The contractor arrives on-site at 1159 CST. The contractor reports that all of the diesel fuel has been released from 2 x 75-gallon saddle tanks and approximately 15 gallons of engine oil from the oil pan, impacting an area of approximately 200' x 200' in the soil. The diesel fuel and engine oil have impacted approximately 1/4 mile of the stream which leads to an outfall to the river. The contractor has begun placing down absorbent booms across the stream to prevent any petroleum product from further traveling down the stream. The contractor advises that they are still assessing the impact on the river as well as the initial impact site. The contractor will continue to apply absorbent booms to collect petroleum products. The contractor will pull soil samples from the site. f. The contractor provides an update at 1316 CST. The contractor reports that they were unable to locate any evidence of the release of diesel fuel or engine oil in the river. The contractor advises that the towing vendor is beginning to remove the tractor from the initial site. Once the tractor has been removed from the site, the contractor will begin taking soil samples from around the impact area. The contractor will secure the impacted soil for possible excavation. The contractor will provide an updated assessment once the tractor and trailer have been removed from the site. g. PES reached out to Charlie with Western Express at 1419 CST to update him on the new plan of action due to Hazmat Capital Waste being unwilling to give up the site. PES stated that Hazmat Capital Waste is not giving up the site and stated that they are going to continue the remediation. To prevent any hostile work environment, PES instructed our contractor (First Call) to end remedial action work but remain on-site to oversee and document the remedial action work performed by Hazmat Capital Waste. Charlie agrees with the plan of action and wants First Call to remain on-site to oversee further remediation performed by Hazmat Capital Waste. PES will continue to make updates and provide updated photos of the remedial action work performed by Hazmat Capital Waste. h. The contractor provides an update at 1527 CST. The contractor advises that Hazmat Capital Waste is currently offloading the freight from the trailer. The contractor reports that Hazmat Capital Waste has a Skid Steer and a Mini Excavator on-site to excavate the impacted soil. The contractor (First Call) will take soil samples once Hazmat Capital Waste has completed their excavation to ensure all petroleum products have been removed from the soil. i. The contractor provides an update at 1639 CST. The contractor reports that Hazmat Capital Waste is continuing to offload the freight from the trailer. The contractor reports that there are approximately 4 Hazmat Capital Waste personnel on-site and 3 x roll-off boxes. The contractor will continue to monitor and oversee the remediation of the site work. The contractor will provide PES with updated photos as they become available. j. The contractor provides an update at 1753 CST. The contractor reports that the following equipment is being utilized by the contractors on-site. 3x roll-off trucks 2x flat beds 2x rotator 2x pick up 1x excavator 1x skid steer 1x vac truck The contractor Date of Incident: Friday, June 2, 2023 PES Incident#: 23-005-06051 State: North Carolina County: Iredell State Report#: 20230602-04 NRC Report#: 1368925 continues there observation noting that there is a 50-foot trail along the Rockwall and that the Rockwall will need to be removed before anyone can see how bad the soil under it has been impacted. k. PES contacts Charlie Haines, Western Express to provide an update at 1906 CST. The contractors state that the active contractor which PES did not hire is now requesting assistance from First Call. PES explains to the contractor that mixing the work is not ideal because invoicing can be difficult and given the current tension between the two contractors it was not a good idea. PES speak with Charlie for guidance on this development. He advises PES that he would like the contractors to continue monitoring the response and documenting equipment and personnel per the original agreement until there is a good stopping point where observation will no longer be needed. PES relays the information to the contractor who agrees to continue observing and reporting. l. The contractor provides an update at 2058 CST. The contractor reports that the semi has been removed from the tree line and the area is being dug up by the contractors on- site. The contractor advises that once the area is dug he will take additional photos. m. The contractor provides an update at 2151 CST. The contractor reports that the crew that was conducting the remediation has demobilized. The contractor advises that no remediation to the soil was completed, once the truck was removed from site all work seized. PES will speak with the client on Monday to determine if the area needs to be excavated and if they would want PES to manage it. The contractor is preparing to demobilize, initial site work is complete. 9. Documentation? a. PES is preparing the final report, containing the waste manifest. 10. Causes? a. Single vehicle accident, the driver left the road and ran into a tree line, causing the release.
