I write in response to the Notice of Regulatory Requirements dated September 26, 2023, to provide additional information germane to the UST Section’s handling of Incident No. 49209 at 1203 North Barkley Road, Statesville, North Carolina (the “Property”). The contamination described in the 24-Hour Release and UST Leak Reporting Form (the “Form”) submitted on behalf of RUS by ATC Group Services (“ATC”) was identified in the course of due diligence by Cintas pursuant to a contract for the sale of the assets of RUS to Cintas. In particular, ATC conducted Phase I and Phase II Site Assessments on behalf of Cintas, the latter of which were disclosed to RUS immediately prior to the sale. The submission of the Form occurred concurrently with the sale to Cintas, and we understand that ATC immediately filed an amended Leak Reporting Form once the transaction was closed, on or around July 31, 2023. As part of the sale, Cintas accepted responsibility to address the contamination described in the Form to the satisfaction of DEQ (e.g., No Further Action or Notice of Residual Petroleum). We understand that ATC is already working with DEQ to reach that outcome. While we understand that Cintas and ATC (or other similarly qualified consultant) are addressing the contamination to UST Section’s satisfaction, please do not hesitate to contact me by phone or email if you need any additional information regarding the status of RUS.
