Shinn and Mr. Ernest Arthur Deal) and Pulte Home Company, LLC (prospective property purchaser), ESP Associates, Inc. (ESP) is pleased to present the following documentation regarding the closure by removal of an approximate 1,000-gallon residential heating oil underground storage tank (UST). The UST was located on Tax Parcel No. 118159, which is an approximate 6.91-acre Site located northwest of the intersection of Miller Road and West Church Street in China Grove, North Carolina (see Figures 1 and 2 in Attachment 2). The UST was previously used for heating the single-family residential structure located on the subject Site which has a listed street address of 140 Miller Road, China Grove, North Carolina (see Figures 2 and 3 in Attachment 2). The residence is reported to be currently vacant. In accordance with North Carolina Department of Environmental Quality (NCDEQ) UST Section guidelines, USTs that contain heating oil that is used on the premises where stored are non-regulated USTs. BACKGROUND A report titled “Phase I Environmental Site Assessment - 140 Miller Road, China Grove, North Carolina” dated March 17, 2022, by LaBella Associates, D.P.C. (LaBella), identified a heating oil UST associated with the 140 Miller Road residence. LaBella stated that the heating oil UST was located on the south exterior of the residence (see Figures 1 through 3 in Attachment 2 for the UST location). A report titled “Phase II Environmental Site Assessment - 140 Miller Road, China Grove, North Carolina” dated May 2022, by LaBella (copy provided in Attachment 3), stated that LaBella advanced three direct push soil borings in the immediate area of the UST. LaBella reported that groundwater was not encountered in any of the soil borings which were advanced to a depth of UST Closure and Site Check Report ESP Project E6-KU17.600 140 Miller Road Site December 7, 2022 2 16 feet below ground surface (ft bgs). LaBella also stated that topography slopes slightly to the west towards Grant’s Creek, which is located over 1,800 ft away from the UST (see Figure 1 in Attachment 2). Photoionization detector (PID) readings taken at 2-ft intervals during soil boring advancement yielded trace total volatile organic compounds (VOCs), with the highest total VOC measurement being 1.1 parts per million (ppm). Based on the PID readings and Site topography, LaBella collected two soil samples from the soil borings located approximately 2 ft west of the UST and at a depth of 10-12 ft bgs. LaBella collected these two soil samples on April 26, 2022, and submitted them to Pace Analytical (Pace), a North Carolina-certified laboratory, to be analyzed for VOCs, semi-volatile organic compounds (SVOCs), diesel range organics (DRO), and oil range organics (ORO). The laboratory analytical results for the two soil samples were non-detect for VOCs, SVOCs, and DRO with the exception an o-xylene detection in one of the soil samples at a trace concentration of 0.0095 milligrams per kilogram (mg/kg) which is well below both the soil-to-water and residential maximum soil contaminant concentrations (MSCCs) for o-xylene of 6 mg/kg and 3,120 mg/kg, respectively. ORO (which Pace reported as being C28-C40 compounds) were non-detect in one soil sample and 21.2 mg/kg in the other soil sample. Although NCDEQ does not have a screening level specifically for ORO, the detected concentration is well below the NCDEQ screening level for the lighter DRO (which Pace reported as being C10-C28 compounds) of 100 mg/kg. Based on these results, LaBella recommended no further investigation of the UST. UST REMOVAL ESP procured the services of CCI Environmental Services, Inc. (CCI) of Thomasville, North Carolina, to remove the heating oil UST located adjacent to the south side of the 140 Miller Road residence (see UST location on Figures 2 and 3 in Attachment 2). A Site Investigation Report for Permanent Closure or Change-In-Service of Un-registered UST (Form UST-2B) is provided in Attachment 4. Field documentation and photographs documenting the removal of the UST are provided in Attachments 5 and 6, respectively. Prior to mobilizing to the site, ESP contacted NC811 who marked the location of the buried electrical line adjacent to the UST (see photograph in Attachment 6). On October 10, 2022, CCI excavated above and around the UST using a trackhoe to expose the tank. The tank was found to have approximate dimensions of 4 ft diameter and 10 ft 7 inches length, yielding an approximate capacity of 1,000 gallons. Once the UST was exposed, CCI pumped out approximately 14 gallons of fluid (designated Non-Hazardous Liquid N.O.S.) from the UST using a vacuum truck. On October 10, 2022, CCI transported the fluid off-Site under non-hazardous waste manifest to its facility located at 708 Martin Luther King Jr Drive, Thomasville, North Carolina, where the fluid was solidified (see copy of the non-hazardous waste manifest in Attachment 7) prior to permitted disposal at an NCDEQ-approved facility. Once the fluid was removed from the UST, the UST was removed from the ground. The dimensions of the tank pit excavation measured approximately 14 ft by 9 ft by 5.5 ft bgs. Groundwater was not encountered in the tank pit. There was no visual evidence of a release either on the tank itself or at the base of the tank pit (see photographs in Attachment 6). PID readings of the soil at the base of the tank pit ranged from non-detect to 0.1 ppm total VOCs. UST Closure and Site Check Report ESP Project E6-KU17.600 140 Miller Road Site December 7, 2022 3 On October 10, 2022, CCI transported the tank off-Site to D.H. Griffin Wrecking Company, Inc. located at 2705 W English Street, High Point, North Carolina, for recycling (see copy of the non- hazardous waste manifest for the tank and the tank recycling receipt in Attachment 7). SITE CHECK SOIL SAMPLING AND ANALYSIS On October 10, 2022, following removal of the UST from the ground, ESP collected two site check soil samples, designated SS-1 and SS-2, from the base of the tank pit at a depth of approximately 6 ft bgs beneath the centerline of the removed UST on either end of where the tank was located. Field documentation and photographs documenting the site check soil sample collection are provided in Attachments 5 and 6, respectively. Soil samples SS-1 and SS-2 were placed in laboratory-provided containers, labeled, stored on ice in a cooler, and hand delivered under standard chain-of-custody procedures to Pace to be analyzed for DRO and gasoline range organics (GRO) by EPA Method 8015. On October 10, 2022, following collection of the site check soil samples, CCI placed the unimpacted overburden soil excavated during the UST removal back into the excavation in lifts and tamped the material with the bucket of the trackhoe. CCI imported fill dirt from off-Site to the 140 Miller Road Site to fill in the remaining volume of the excavation (see copy of the import soil receipt in Attachment 7). The backfilled tank pit was graded, seeded, and covered with straw by CCI (see photographs in Attachment 6). Results of the laboratory analysis of site check soil samples SS-1 and SS-2 are documented in the laboratory analytical report (see Attachment 8) and summarized in Table 1 in Attachment 1. Figure 3 in Attachment 2 depicts the site check soil sampling locations within the tank pit and presents the laboratory analytical results. GRO was non-detect in both site check soil samples. DRO was detected in both site check soil samples at concentrations of 13.1 mg/kg in SS-1 and 295 mg/kg in SS-2. DRO in site check soil sample SS-2 exceeded NCDEQ’s soil screening level for DRO of 100 mg/kg, indicating that a release had occurred. A 24-Hour Release and UST Leak Reporting Form for the release was submitted to NCDEQ on December 7, 2022. ADDITIONAL RISK-BASED SOIL SAMPLING AND ANALYSIS The DRO results were unexpected based on the visual observations of the tank and tank pit following UST removal along with the PID readings that ranged from non-detect to 0.1 ppm. Therefore, additional risk-based soil sampling and analysis was performed to further characterize the soil at the base of the tank pit at the SS-2 site check soil sampling location. Field documentation and photographs documenting the risk-based soil sample collection are provided in Attachments 5 and 6, respectively. On November 3, 2022, a soil boring was advanced using a decontaminated stainless-steel hand auger at the approximate location of site check soil sample SS-2. The approximate SS-2 location was located using a tape measure and prior recorded measurements along with visual observation of the restored tank pit excavation area. The soil boring was advanced through backfill soils placed in the tank pit until residual soils were encountered at 6.5 ft bgs (see boring log in Attachment 5). Soil sample SS-2R was then collected from 6.5 to 7 ft bgs and placed in UST Closure and Site Check Report ESP Project E6-KU17.600 140 Miller Road Site December 7, 2022 4 laboratory-provided containers, labeled, and stored on ice in a cooler. The risk-based soil sample was hand delivered under standard chain-of-custody procedures to Pace to be analyzed for VOCs by EPA Method 8260, SVOCs by EPA Method 8270, MADEP volatile petroleum hydrocarbons (VPH), and MADEP extractable petroleum hydrocarbons (EPH). Results of the laboratory analysis of risk-based soil sample SS-2R are documented in the laboratory analytical report in Attachment 8 and summarized in Table 1 in Attachment 1. Figure 3 in Attachment 2 depicts the risk-based soil sampling location and presents the laboratory analytical results. VOCs, SVOCs, MADEP VPH, and MADEP EPH were non-detect in the risk-based soil sample with one exception. Methylene chloride was detected in the risk- based soil sample at a trace concentration of 0.0451 mg/kg, which exceeded the soil-to-water MSCC for methylene chloride of 0.023 mg/kg but was below the residential MSCC of 93.8 mg/kg. As noted in the laboratory analytical report, methylene chloride is a common laboratory contaminant. Therefore, the presence of trace levels of methylene chloride in the absence of other petroleum compounds is believed to be the result of laboratory contamination rather than released petroleum. RECEPTOR SURVEY One water supply well (WSW) is located within a 150-ft radius of the UST release. This WSW is associated with the 140 Miller Road residence and is currently not being used since the house is reportedly vacant. The WSW location is depicted on Figure 3 in Attachment 2. The presumed shallow groundwater flow direction at the former UST location based on surface topography is west towards Grant’s Creek (i.e., away from the WSW). CONCLUSIONS The laboratory analytical results for one of the two site check soil samples collected on October 10, 2022, from the base of the tank pit following removal of the 1,000-gallon residential heating oil UST had a DRO concentration of 295 mg/kg which exceeded the NCDEQ screening level for DRO of 100 mg/kg, indicting that a release had occurred. Although a release had occurred based on the site check soil sample results, a No Further Action determination is requested based on the following observations and findings:  Two soil samples collected on April 26, 2022, within 2 ft of the UST in a topographically down-slope direction and from a depth of 10-12 ft bgs prior to removal of the UST were: non-detect for VOCs, SVOCs, and DRO with the exception of a trace o-xylene concentration in one of the samples well below the soil-to-water MSCC; and were either non-detect or less than the NCDEQ DRO screening level for the heavier and less mobile ORO (C28-C40 compounds).  Upon removal of the UST from the ground on October 10, 2022, the tank appeared to be intact with no holes or staining, and there was no visual or PID reading evidence of a release in the tank pit.  Both site check soil samples collected on October 10, 2022, from the base of the tank pit following removal of the 1,000-gallon residential heating oil UST were non-detect for GRO. UST Closure and Site Check Report ESP Project E6-KU17.600 140 Miller Road Site December 7, 2022 5  The additional analytical results for a risk-based soil sample (collected on November 3, 2022) co-located with the site check soil sample that exceeded the NCDEQ screening level for DRO was found to be non-detect for VOCs, SVOCs, MADEP VPH, and MADEP EPH with the exception of a trace level of methylene chloride (a common laboratory contaminant) slightly above the soil-to-water MSCC.  Groundwater is reportedly present at greater than 16 ft bgs in the vicinity of the UST.  Apparent groundwater flow direction in the vicinity of the UST based on surface topography is to the west toward Grant’s Creek and away from the subject Site’s WSW which is currently not in use since the residence is vacant. (“LaBella”) was retained by Pulte Group to conduct a Phase II Environmental Site Assessment (ESA) at the property located at 140 Miller Road, in China Grove, Rowan County, North Carolina, hereinafter referred to as the “Subject Property” (see Figure 1). This Phase II ESA has been performed in conformance with the scope and limitations of ASTM Practice E 1903-19. 1.1 Terms & Conditions The findings of this Phase II ESA are based on the scope of work and project objectives as stated in LaBella proposal number P2202165, dated March 24, 2022. 1.2 Limitations & Exceptions Work associated with this Phase II ESA was performed in accordance with generally accepted environmental engineering and environmental contracting practices for this region. LaBella Associates, P.C., makes no other warranty or representation, either expressed or implied, nor is one intended to be included as part of its services, proposals, contracts, or reports. In addition, LaBella cannot provide guarantees, certifications, or warranties that the property is or is not free of environmental impairment or other regulated solid wastes. The Client shall be aware that the data and representative samples from any given soil sampling point or monitoring well may represent conditions that apply only at that particular location, and such conditions may not necessarily apply to the general Subject Property as a whole. 2.0 BACKGROUND 2.1 Subject Property Description & Features The Subject Property comprises approximately 8.2 acres of land and is currently developed with one single-story 2,143 square-foot unoccupied single-family residence, a detached garage, and several barn structures. The exterior portions of the Subject Property consist of mowed grassy areas, agricultural land, and gravel parking areas. The subject buildings were constructed in at least 1940 and 1970. 2.2 Physical Setting The Subject Property is located in a rural area, and the topography in the area slightly slopes towards the west. The nearest surface water body is an unnamed tributary of Grants Creek, approximately 1,500 feet west of the Subject Property. 2.3 Subject Property History & Land Use Based on the findings of a Phase I ESA recently performed for the Subject Property (see Section 2.5 below), the Subject Property has been developed with a residential dwelling from at least 1940 until the present. The Subject Property was first developed with the current buildings in at least 1940 and 1970. The Subject Property uses included agricultural and residential. 2.4 Adjacent Property Use The Subject Property is bordered by the following properties: 2 2.5 Summary of Previous Environmental Investigations The following previous environmental reports exist for the Subject Property: Phase I Environmental Site Assessment, prepared by LaBella Associates, dated March 18, 2022 The 2022 LaBella report identified the following Recognized Environmental Conditions (RECs) connected with the Subject Property: • At the time of the site reconnaissance, a vent pipe and a fill pipe were observed protruding out of the ground on the south exterior of the residence. According to Ernest Deal (owner), these pipes are associated with an approximately 500-gallon fuel oil UST which was installed approximately 30 years ago. As of the date of this report submission, additional information regarding the exact age and integrity of the UST (i.e. tank installation documentation, tank testing results, etc.) have not been provided to LaBella. Objective The objective of this Phase II ESA was to conduct an evaluation of subsurface conditions at the Subject Property to assess the RECs identified within the Phase I ESA. 3.0 SCOPE OF WORK To achieve the project objectives the following Scope of Work was performed: 1. Prior to initiating subsurface activities, an underground utility stake-out, via North Carolina 811 was completed at the Subject Property to clear all boring locations. 2. A direct push soil boring and sampling program of the overburden at the Subject Property was implemented. Soil borings were advanced with a truck-mounted Geoprobe® direct-push sampling system by The Probing Company (headquartered in Atlanta, GA). The use of direct- push technology allows for rapid sampling, observation, and characterization of overburden soils. The Geoprobe utilizes a 4-foot MacroCore® sampler with disposable polyethylene liners. Soil cores are retrieved in 4-foot sections and can be easily cut from the polyethylene liners for observation and sampling. A total of three (3) soil borings were advanced at the Subject Property to a maximum depth of sixteen (16) feet (ft) below ground surface (bgs). Soil boring locations are depicted in Figure 2. 3. Soils from the borings were continuously assessed for visible impairment, olfactory indications of impairment, and/or indication of detectable volatile organic compounds (VOCs) with a photo-ionization detector (PID). Positive indications from any of these screening methods are collectively referred to as “evidence of impairment.” 4. The soil borings were not converted to temporary overburden groundwater monitoring wells. At the time of the sampling program, we did not encounter saturated conditions in the overburden soils. Soil samples were placed in a cooler on ice and handled under strict chain-of-custody procedures. Samples were submitted to Pace Analytical Services, LLC (“Pace”), with analysis and results provided by their laboratory in Huntersville, North Carolina. Pace maintains Field Lab Certification with the North Carolina Department of Environmental Quality (NCDEQ). The following laboratory analysis was performed: a. Soil Sample ID / Location Sample Depth (ft bgs) Laboratory Analyses SB-2 10.0 – 12.0 USEPA TCL VOCs and SVOCs. DRO and ORO. SB-3 10.0 – 12.0 USEPA TCL VOCs and SVOCs. DRO and ORO. Notes: 1. USEPA Target Compound List (TCL) VOC analysis performed via USEPA Method 8260 2. USEPA TCL SVOC analysis performed via USEPA Method 8270 3. Diesel Range Organics (DRO) analysis performed via USEPA Method 8015 Modified 4. Oil Range Organics (ORO) analysis performed via USEPA Method 8015 Modified Prior to leaving the Subject Property, LaBella personnel backfilled the borings with soil cuttings and bentonite. 4.0 FINDINGS 4.1 Site Geology and Hydrology Three (3) soil borings were advanced at the Subject Property on April 26, 2022, designated SB-1 through SB-3. SB-1 was installed approximately two (2) feet south of the UST. SB- 2 and SB-3 were installed approximately two (2) feet west of the UST. Terminal depths of the borings were approximately sixteen (16) feet bgs. All soil cores were continuously assessed for soil type and evidence of impairment. Refer to Section 5.2 for information regarding field screening results. Surface conditions at the Subject Property consist of grass and topsoil to a depth of four (4) inches bgs. Subsurface soils encountered during the investigation generally consisted of orange/reddish clay. Indications of groundwater (i.e., moisture) were not observed. For a complete description of the soil lithology at each boring location, refer to the soil boring logs included in Appendix 1. Soil boring locations are shown in Figure 2. 4.2 Field Screening Results All soils were continuously screened using a Minirae 3000 photoionization detector (PID). The readings obtained provide only an indication of the relative levels of VOC presence in the soil and are not considered to be a direct quantization of actual soil VOC concentration. 3. “*” denotes a soil sample was submitted for laboratory analysis from this interval. 4.3 Laboratory Analytical Results 4.3.1 Soil Two (2) soil samples were selected for laboratory analysis and submitted for USEPA TCL volatile organic compounds (VOCs), semi-volatile organic compounds (SVOCs), and Diesel-Range and Oil- Range Organic compounds (DRO/ORO). Soil sample analytical results for VOCs and SVOCs were compared to the North Carolina Department of Environmental Quality (NCDEQ) Preliminary Soil Remediation Goals (PSRGs). Soil sample analytical results for DRO and ORO compounds were compared to the NCDEQ Total Petroleum Hydrocarbon (TPH) Action Levels. VOCs: VOCs were not detected above laboratory method detection limits (MDLs) in the soil sample collected from SB-3. VOCs were not detected above the MDLS in the soil sample collected from SB-2 with the exception of o-Xylene, which was detected at a concentration of 0.0095 milligrams per kilogram (mg/kg), which is below the NCDEQ PSRGs of 140.0 mg/kg (Residential Health-Based), 590.0 mg/kg (Industrial/Commercial Health-Based), and 9.8 mg/kg (Protection of Groundwater). SVOCs: SVOCs were not detected above laboratory MDLs in any of the soil samples collected during this investigation from SB-2 or SB-3. DRO: DRO compounds (C10-C28) were not detected above laboratory MDLs in the soil samples collected during this investigation from SB-2 or SB-3. ORO: ORO compounds (C28-C40) were not detected above laboratory MDLs in the soil sample collected from SB-2. ORO compounds (C28-C40) were detected above MDLs in SB-3 at a concentration of 21.2 mg/kg. However, the concentration of ORO compounds (C28-C40) was below the NCDEQ TPH Action Level of 50.0 mg/kg. It should be noted that the TPH carbon ranges used in the NCDEQ TPH Action Levels may not exactly match the carbon ranges from the laboratory results. The laboratory report is included as Appendix 2. 5.0 CONCLUSIONS LaBella was retained by Pulte Group to conduct a Phase II ESA at the property located at 140 Miller Road, China Grove, North Carolina 28303. The ESA consisted of the advancement of three (3) soil borings and laboratory analysis of two (2) soil samples. This ESA was performed to evaluate the Subject 5 Property subsurface at specific locations based on the presence of a historical heating oil UST at the Subject Property. The following conclusions have been drawn: • Soils at the Subject Property generally consisted of orange/reddish clay. Indications of groundwater (i.e. moisture) were not observed. • Three (3) soil borings were advanced in the nearest feasible vicinity of the apparent heating oil UST. Visual or olfactory evidence of impairment was not encountered in soil borings SB-1 through SB-3. • Targeted VOCs were not detected above laboratory MDLs and/or their respective NCDEQ PSRGs in any of the two (2) soil samples collected. • Targeted SVOCs were not detected above laboratory MDLs and/or their respective NCDEQ PSRGs in any of the two (2) soil samples collected. • Diesel-Range Organic compounds were not detected above laboratory MDLs in the two (2) soil samples collected for DRO analysis. • Oil-Range Organic compounds were not detected above the NCDEQ TPH Action Level in the two (2) soil samples collected for ORO analysis. 6.0 RECOMMENDATION The REC identified in the Phase I ESA recently completed for the Subject Property (dated March 18, 2022) has been examined by this Phase II ESA. Based on the results of this investigation, the lack of observed field evidence of impact, and the lack of detected compounds above applicable NCDEQ PSRGs or TPH Action Levels, no further investigation appears warranted at this time. In addition, the NCDEQ advises emptying a non-regulated tank once it is no longer being used to limit the chances of a release.
