Dear Mr. Geneshji:
Information received by this office of the UST Section, Division of Waste Management, on June 16, 2023,
indicates that a release or discharge from a petroleum underground storage tank (UST) system may have
occurred at the above-referenced location. Records indicate that you are the owner or operator of this UST
system. You have failed to submit a Site Check Report in accordance with Title 15A NCAC 2N .0603 to
the UST Section within 30 days of the receipt of the Notice of Regulatory Requirement dated June 19,
2023, in which the site check was requested.
Please submit a Site Check Report in accordance with Title15A NCAC 2N .0603 and the latest version of
the Guidelines for Site Check, Tank Closure, and Initial Response and Abatement for UST Releases. A Site
Check Report must be received by the Mooresville Regional Office within 30 days of receipt of this notice
to avoid recommendation of civil penalties for continuing violations. Based on a review of the information
submitted in the Site Check Report, the Department of Environmental Quality will determine if the incident
meets the criteria for No Further Action.
Penalties may be assessed for the violation described within this Notice of Violation. Your prompt attention
to the items described herein is required. Failure to comply with the State's rules, in the manner and time
specified, may result in the assessment of additional civil penalties and/or the use of other enforcement
mechanisms available to the State. Each day that a violation continues may be considered a separate
violation.
