The Yard Waste Notification renewal form was received on May 30, 2023. PURPOSE OF SITE VISIT:
Follow-up Compliance Inspection STATUS OF PAST OBSERVED VIOLATIONS: A. 15A NCAC 13B .1406 (6), “A site shall only accept those solid wastes that it is permitted to receive.”
CORRRECTIVE ACTIONS IN PROGRESS: At the time of this inspection, the overall amount of commingled municipal solid waste (MSW) and windblown litter located at the facility was reduced.
However, significant MSW, including plastic bottles, aluminum soda cans, and household garbage remained
on top of and mixed within the compost/soil mixture located in the southeastern corner of the facility. MSW was also identified on top of and within the composted yard waste piles, some of which, Mr. Elliot stated, have been on site for approximately 3 years. Ensure all compost and soil containing MSW in the southeastern corner of the facility is scraped up and removed until only clean native soil remains. All
excavated material from the southeastern corner shall be disposed of at a permitted landfill. In

addition, the large eastern compost pile and the smaller western compost pile need to be removed from the site, and either hauled to a commercial composter or to a permitted landfill.
OBSERVED VIOLATIONS: B. 15A NCAC 13B .1406 (4), “Leachate shall be contained on site or treated prior to discharge.” During this inspection, leachate was observed seeping from the eastern compost pile, flowing northward, and pooling adjacent to the wood line along the northern facility boundary. Immediately implement measures to stop the flow of leachate and prevent it from leaving the facility grounds. All impacted soils need to be excavated and disposed of properly at a permitted facility. Ensure that the facility grounds are graded to direct leachate back into the operations area or into a collection system.
ADDITIONAL COMMENTS
1. NCGS, Article 9, Chapter 130A-309.05 (1), (2), “Seventy-five percent (75%), by weight or volume, of
the recovered material stored at a facility at the beginning of a calendar year commencing January 1, shall be removed from the facility through sale, use, or reuse by December 31 of the same year. See “Status of Past Observed Violations, A.” above. Mr. Elliot stated that the eastern and western compost piles have been on site for approximately 3 years. Material must be processed and removed from the site on a regular basis, so that 75 percent, by weight or volume, is removed within a calendar year of receipt. Yard
Waste Notification facilities are not approved for permanent storage or final disposal. Please remove all the eastern and western compost piles within 60 days of receipt of this report. The material can be hauled to a commercial composter, or once MSW is removed, hauled to a permitted landfill to be mixed with cover soil and/or used as alternative daily cover (ADC). 2. Orange traffic drums have been placed at each of the four corners of the facility to delineate the limits of the
two-acre notification.
3. Corrective measures are necessary as a result of this inspection and should already be underway. The flow of leachate should be stopped right away, and the removal of the eastern and western compost piles should be completed within 60 days of receipt of this report.
