December 13, 2022 - Permit to Construct 7803-LCID-2022 4 Acre expansion; Permit to Operate current 3 Acre LCID (this was reissued to address wording and some issues with 3/17/2022 PTC/PTO.) PURPOSE OF SITE VISIT: Comprehensive Inspection – Follow Up STATUS OF PAST NOTED VIOLATIONS: 1. 15A NCAC 13B .0564 (7) – UNRESOLVED. 2. 15A NCAC 13B .0566 (3) - RESOLVED. 3. 15A NCAC 13B .0566 (4) – UNRESOLVED. 4. 15A NCAC 13B .0566 (7) – UNRESOLVED. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 OBSERVED VIOLATIONS: During the previous inspection, 1/4/2024, there were areas identified on the LCID that did not have appropriate cover. Upon inspection on 4/23/2024 of the LCID, some of the same areas still had not been addressed. After the inspection, photos were reviewed of the northern and eastern areas of the LCID, showing they still had the same exposed waste and erosion as identified before during the 1/4/2024 inspection. In addition, roads were impassable along the south side and no perimeter road has been created or begun development to meet rule. There is essentially no road along the east side of LCID. Previous inspection identified the need for repairs on some areas of the existing access road, specifically the south side. All cover should be a minimum of six inches for proper depth and in areas that will not have waste for three months or more should have at least twelve inches of soil cover. Please cover with appropriate soil, grade, and slope to meet rules. A perimeter road giving access to firefighting equipment and Department vehicles should be constructed. The new road, along with the existing roads, should be of all-weather construction. 15A NCAC 13B .0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (Facility Permit Attachment 3, Part V, 71 also). 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles. The purpose of this visit was to do a follow-up inspection of the Robeson County Landfills and corrective actions previously identified. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. Mr. Walters and Ms. Locklear explained that a request for bids was put out for constructing the new LCID expansion but there were no bids submitted. During inspection, there was someone interested in putting in a bid, on the second bid announcement coming soon, but they wanted to inspect the area to estimate the job. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres. EOW markers were visible around most of the LCID, but some are needed, one should be visible to the next. 2. The LCID working face was approaching max size, although cover was being done during inspection. There was unapproved waste visible during inspection, such as pallets and bagged trash. Attendant should inspect the loads for unapproved wastes during dumping and remove unapproved wastes to appropriate disposal site. Be sure all waste is covered when reaching one acre in size or monthly and please slope 3:1. Please remove all unapproved waste to proper disposal site. 15A NCAC 13B .0566 (1) The site shall only accept those solid wastes that it is permitted to receive. Working face unapproved wastes. Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 6 of 9 3. Mulch has been previously used for erosion control, slope stabilization and to encourage vegetation as a top dressing. On the south side of the LCID it was previously too thick. The previous areas of deep mulch seem to have been addressed and smoothed out. Good job. These areas need appropriate cover, stabilized, and perennial vegetation established if not going to have waste within 3 months, per rule. Please address accordingly. 4. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted. Center of LCID with recent cover added. Corrective measures are necessary as a result of this inspection. A follow-up inspection will be conducted by Solid Waste Section Staff in about 30 days from the inspection sent date. Failure to bring the site into compliance may result in further enforcement actions up to and including a compliance order with penalties.
