OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0542 (f) (3) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph.
Upon inspection, previously identified violations are still occurring, as well as new violations being observed. Section staff visited the CDLF landfill open phase and a large area was observed still with exposed waste at a
lower elevation, between the inactive phase and active phase, causing water to impound over waste. In addition, along the outside edge of waste, there were also some areas with exposed waste and erosion rills. There was also severe erosion on the NE road access to the top of the older phase of the CDLF, which showed there was
insufficient soil cover in that area and exposed waste. Soil was staged and slowly being eroded from rainfall and not being utilized for cover. An appropriate amount of soil cover should be compacted, graded, and sloped in a manner to restrain erosion while allowing stormwater to divert from the landfill surface. Water should not be
impounded over waste. After proper cover, compaction, roads should be left in such a manner as to not continue to be an issue while still providing access to the top of older phases for maintenance and repair.

ADDITIONAL COMMENTS
1. The purpose of this visit was to have a follow-up inspection of the Robeson County Landfills and previously identified corrective actions. Mr. Powell met with Mr. Walters and Ms. Locklear once onsite and before riding around the facility.
2. The working face was of the appropriate size, and the waste seemed to be compacted good.
3. Windblown was not an issue at the CDLF and was being picked up during inspection. Good job. 4. The side slopes looked to have been mowed in recent weeks but there was still some overgrown vegetation in some areas around the limits of disposal and ditches. The top of the older phases was not visited during this inspection. 5. CDLF working face was near NE side of new phase, which is on the west end of CDLF. No unapproved wastes were visible during inspection. Cover is still an issue across the open phase of the new phase and should be addressed.

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

8. The pallet area had some unapproved painted pallets in the pile, be sure and remove.

9. The scrap metal, electronics and white goods area needs addressing. All electronics should be either containerized or palletized and not allowed to be broken and scattered off concrete pad. This can lead to heavy metals leaching into surrounding soil. White goods should be stored upright until a certified person removes the gases. Once gas removal has occurred, units should be marked as such, and can then be managed in containers or piles until they are removed for recycling.

10. 15A NCAC 13B .0534 (b)(2)(I) Proper Operation and Maintenance. The permittee shall at all times operate and maintain all facilities and systems of treatment and control and related appurtenances which are installed or used by the permittee in compliance with the conditions of the permit. Proper operation and maintenance include effective performance, adequate funding, adequate operator staffing and training, and adequate laboratory and process controls, including appropriate quality assurance procedures, in accordance with the conditions of the permit. This provision requires the operation of back-up or auxiliary
facilities or similar systems only when necessary to achieve compliance with the conditions of the permit. 11. Corrective measures are necessary. A follow-up compliance inspection will be conducted by Solid Waste Section Staff within about 30 days’ receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
