This Notice is part of a remedial action for the Site that has been approved by the Secretary (or his/her delegate) of the North Carolina Department of Environmental Quality (or its successor in function), as authorized by N.C.G.S. Section 143B-279.9 and 143B-279.11. The North Carolina Department of Environmental Quality shall hereinafter be referred to as "DEQ". NOTICE Petroleum product was released and/or discharged at the Site. Petroleum constituents remain on the site, but are not a danger to public health and the environment, provided that the restrictions described herein, and any other measures required by DEQ pursuant to N.C.G.S. Sections 143B-279.9 and 143B-279.11, are strictly complied with. This "Notice of Residual Petroleum" is composed of a description of the property, the location of the residual petroleum and the land use restrictions on the Site. The Notice has been approved and notarized by DEQ pursuant to N.C.G.S. Sections 143B-279.9 and 143B-279.11 and has/shall be recorded at the Cumberland County Register of Deeds' o~Fe Bs~ok;Y ,_, Page ~,_. BK 11767 PG 0016 Source Property The Notice of Residual Petroleum recorded in Book 11731, Page 352 in the office o~the Register of Deeds of Cumberland County incorrectly stated that William T. Sanders was the owner of all of a portion of the Site. This Notice of Residual Petroleum is being recorded to correct the name of the owner. William T. Sanders and Peter G. Kramer. Trustees, or their successors intrust, under The William T. Sanders Revocable Trust dated Apri123, 2009. and any amendments thereto, of 2 Scotch Bonnet Lane Wrightsville Beach, NC 28480 is the owner in fee simple of all or a portion of the Site, which is located in the County of _Cumberland State of North Carolina, and is known and legally described as: BEGINNING at a concrete monument at the intersection of the Eastern margin of Third Street (a fifty-foot street) with the Western mazgin of Robeson Street (100 feet wide) and running thence with the Eastern margin of Third Street North 33 degrees 47 minutes West 536.4 feet to a concrete monument; thence North 59 degrees 55 minutes East 87.4 ft. to a . concrete monument; thence North 30 degrees OS minutes West 145 feet to a concrete monument in the Southern margin of Weiss Avenue; thence with it North 59 degrees 55 minutes East 250 feet to a concrete monument; thence South 30 degrees OS minutes East 218 feet to a concrete monument (a corner of the subdivision known as Pleasant View as recorded in Book 10, page 67); thence with said Line South 57 degrees 14 minutes East 174.8 feet to a concrete monument; thence South 79 degrees 50 minutes East 214.3 feet to a concrete monument; thence South 29 degrees 30 minutes East 17.7 feet to a concrete monument in the Western margin of Robeson Street; thence with it South 44 degrees 27 minutes West 354.5 feet to a concrete monument, where the margin of Robeson Street intersects another line of the above-mentioned subdivision; thence South 62 degrees 37 minutes West 95.3 feet; thence South 23 degrees 32 minutes West 82 feet to a concrete monument in the mazgin of Robeson Street; thence South 44 degrees 27 minutes West 42.3 feet to the Beginning. PERPETUAL LAND USE RESTRICTIONS Soil: The Site shall be used for industrial/commercial use only. The above land use restrictions) may also be enforced by DEQ through any of the remedies provided by law br by means of a civil action, and may also be enforced by any unit of local government having jurisdiction over any part of the Site. Any attempt to cancel this Notice without the approval of DEQ (or its successor in function) shall be subject to enforcement by DEQ to the full extent of the law.
