Dear Mr. Ballentine:

On October 21, 2015, Charles Gerstell, Environmental Senior Specialist, representing the State
of North Carolina, Division of Waste Management Solid Waste Section, inspected the above
referenced facility for compliance with North Carolina solid waste statues and rules. The City of
Hickory was found in violation of 15A North Carolina Administrative Code 13B .0201(c) for
operating a solid waste management facility without a currently valid permit. As a result of the
violation, a Notice of Deficiency was issued to the City of Hickory on October 30, 2015.

To achieve compliance, the City of Hickory was required to submit a complete permit renewal
application to include an updated site plan and operational plan to the Solid Waste Section for
review within 30-days of receipt of the Notice of Deficiency. You submitted the requested
information to Larry Frost, Permitting Engineer, by electronic correspondence on November 31,
2015.

This letter serves to confirm that the requirements of the Notice of Deficiency have been
satisfied and the violation has been corrected. Thank you for your cooperation in this matter.
