PURPOSE OF SITE VISIT: Partial Facility Compliance Inspection. STATUS OF PAST NOTED VIOLATIONS: Corrective Action is still in Process. OBSERVED VIOLATIONS: 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES; (f) (2-3) FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 7 ADDITIONAL COMMENTS: 01 - This Life of Site Permit approves the continued operation of the C&DLF Unit phases 1-9 and 3301-COMPOST- 2020. The Permit to Operate for the Edgecombe County C&DLF was recorded in the Edgecombe County Register of Deeds on April 07, 2010, in Deed Book 1551 Pages 645-669. (DIN 10349). 02 - This facility is permitted to receive permitted waste generated in the following North Carolina counties: Edgecombe, Nash, Halifax, Wilson, Pitt, and Martin. 03 - Facility Certified Landfill Operations Specialist: Gloria A. Moseley, expired 10/21/2023, and (primary operator) Brandon Kelly, expires 9/8/2024. No training records were requested or reviewed as part of this site visit. Please ensure required training and training records are up to date. 04 – The compost area was observed, and no compost, yard waste, or tree debris was present the day of this inspection. 05 -The working face appeared to be under ½ acre at the time of this inspection. An exposed asbestos waste pile was observed along the backside of the working face. Erosion was observed down the side slopes, and side slopes needed to be covered. Please continue to keep adequate cover material on the working face so the operator can cover when needing to with cover material, and complete compaction and seeding as needed on areas that will not have any waste added to reduce erosion and potential leachate breakouts. This was mentioned during this inspection. 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES; (f) (2) (3). Rule attached to this report. This was noted in the last inspection report also. 15A NCAC 13B .0542 OPERATION PLAN AND REQUIREMENTS FOR C&DLF FACILITIES (f) Compaction and cover material requirements. Solid waste shall be managed within the disposal area throughout the life-of-site and post-closure care period to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. The owner or operator shall comply with this requirement using the following compaction and cover procedures: (1) The owner or operator shall compact the solid waste. (2) Except as provided in Subparagraph (4) of this Paragraph, the owners and operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly. Cover shall be placed at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires and the generation of odors. A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule. (3) Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered and stabilized with vegetative ground cover or other stabilizing material as provided for in Subparagraph (4) of this Paragraph. (4) Alternative materials or an alternative thickness of cover are allowed with prior approval of the Division if the owner or operator demonstrates that the alternative material or thickness prevents the escape of the waste The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 7 and the attraction of vectors and scavenging and minimizes fires and the generation of odors without presenting a threat to human health and the environment. Alternative materials that have been approved by the Division for use at any C&DLF may be used at all C&DLFs in accordance with G.S. 130A-295.6(h1). 06 -The primary reason for this inspection was to address the temporary manmade holding basin/area for the leachate breakout and for the NC DWM Solid Waste Section permitting engineers to observe the site. The Smith Gardner consultant, Mike Brinchek was onsite and discussed ongoing corrective action plans. 07 - No leachate was noted outside of the landfill footprint during this inspection. However, several areas of liquid that could have been stormwater, condensate, and/or leachate were identified and discussed during the site visit. One area near the temporary manmade leachate holding basin/area should be reviewed. The facility should report back to the Solid Waste Section on the determination of what the liquid is and confirm its origin. Another area by the property line that is adjacent to a farm field and treelined area held standing water that appears to flow into the landfill stormwater drainage culvert. Additional stormwater from a neighboring farm field or treelined area could add unwanted additional volumes of stormwater during storms and heavy rain events. The facility should try to minimize or eliminate stormwater from offsite being diverted into the landfill’s stormwater culvert along the edge of the property. EOW markers need to be re-established on the Western side of the LF as well to ensure that seeps and or releases are not occurring beyond the EOW. 08 - The leachate is still flowing into the temporary manmade holding basin that was created when the leachate breakout was noted (10/07/2021). This area should be pumped daily or as necessary to prevent leachate overrunning the berm and being released from the landfill facility. Report releases. 09 – It is recommended Edgecombe County work with the DWM permitting group to discuss remedies for a more permanent fix to the leachate issues at this facility including concerns of possible groundwater intrusion. This was mentioned during this inspection and the last inspection. 10 – A report dated January 12, 2024, and addressed to DWM Permitting provided a summary of the corrective action plan. An update on corrective action plan drawings is due February 29, 2024. Measures have been taken to repair the leachate breakouts that have now been going on since found on October 07, 2021. 11 - A Notice of Violations was issued on November 17, 2021. A Notice of Continuing Violations was issued upon the findings of the last inspection for not implementing a permanent solution for the temporary manmade holding basin/area. 12 – A pipe was identified during the inspection that was suspected to be a gas system condensate line. The gas system was not operational, and liquid was observed running from the pipe into a drainage ditch outside the EOW. Identification of the pipe and the liquid coming out of the pipe should be conducted as soon as possible, and any liquid from the pipe should be contained and properly managed. 13 - The landfill has been mowed. 14- Some monitoring wells (MW-8R, MW-9A, S&ME P-3R) were observed labelled and locked as required. Groundwater monitoring data was not reviewed. 15 - Gloria Moseley, Solid Waste Director should keep Andrew Hammonds and Autumn Romanski informed of all the progress made to resolve the NOV for this facility. Unidentifed pipe upgradient of the temporary manmade basin/area for collecting leachate. An unknown liquid was observed flowing from the pipe the day of this inspection.
