Yes, that is right. Sorry, I should have sent you this earlier.
For the Earth Farms compost facility, the site owner is in compliance with the Solid Waste rules for the permit renewal
because they have submitted an application for renewal, even when the permit has expired. In accordance with 15A
NCAC 13B .0202 (d), "When a permit applicant submits a complete application for a permit to the Division prior to the
expiration date of the existing permit for the facility, including the payment of an annual fee and permit application fee
if required by G.S. 130A-291.1 or 130A-295.8, the existing permit shall not expire until a decision on the permit
application is made by the Division."
I am reviewing the permit renewal application now, a complete technical review. The major parts are there, so it does
meet the completeness review per NCGS 130A-295.8(e). From my technical review, these are my preliminary comments
thus far:
The site plan layout and size has changed significantly since the site was first permitted. Please provide an
updated site plan drawing, that includes the following. An example site plan drawing is attached.
a. The property boundary in the vicinity of the compost area. Also the boundary of the actual composting
area.
b. The 100-year floodplain boundaries. It appears that portions of the current operation are within the
floodplain, Zone AE shown in blue, both to the east and west. See attached, please clarify.
a. Access roads, existing and proposed, and gates/fences or other access control features.
b. Streams, water bodies, and wetlands located on the property.
c. Location of berms, ditches, basins, and other water control features for the diversion and management
of surface water and process water, and sedimentation and erosion control.
d. Labeled areas for unloading, mixing, processing, composting, curing, material storage, and final product
storage.
c. Utilities and structures/buildings.

Good Afternoon Ms. Wilson,
A while back my boss Mark Farrell received word that your team was short staffed and running months
behind on renewing composting permits, but that we could continue to operate as long as we had submitted
our renewal on time.
Could you please confirm this is the case that the compost permit processing is running behind and that we
can continue to operate using our old permit and it is in good standing?
I am asking for this confirmation so that I can provide to STA folks in order to renew out certifications.

Good morning. I am contacting you to electronically submit a copy of the composting amendment (renewal)
for our site, Earth Farms, SWC-36-13, located in Dallas, per the direction of the Compost Facility Permit
Application Guidance - Types 2, 3, and 4. Additionally we have mailed a hard copy, per the application
guidance, to NC DEQ, Division of Waste Management Sold Waste Section in Raleigh, NC. Please find the
