No AST Closure & Initial Abatement Action Report Hucks Road Apartments 6106 Hucks Road Charlotte, Mecklenburg County, North Carolina NCDEQ Incident No.: Pending November 17, 2021 Page 2 On August 27, 2021, ECS personnel utilized a decontaminated stainless-steel hand auger to conduct two soil borings below the onsite AST. The soil borings were advanced to a depth of 2 feet below the ground surface (bgs). Soils were collected continuously from the ground surface to the termination depth of the soil borings. The soils were screened for evidence of apparent impacts by noting staining, odor and by collecting volatile organic vapor readings using a photoionization detector (PID). The soil interval exhibiting the highest PID readings or visual evidence of apparent impact from each boring was collected and submitted for laboratory analysis to be analyzed for TPH DRO and TPH GRO by EPA Method 8015C. Based on the laboratory analytical results of the soil samples, TPH-DRO was detected at concentrations of 50.4 milligrams per kilogram (mg/kg) and 1,610 mg/kg in soil samples SB-1 and SB-2, respectively. TPH-GRO was not detected at concentrations greater than the laboratory method detection limit in the soil samples. The detected concentration of TPH-DRO in soil sample SB-2 was detected at a concentration greater than the North Carolina Department of Environmental Quality (NCDEQ) Action Level of 100 mg/kg. Based upon the detections of TPH- DRO at concentrations greater than the NCDEQ Action Level, ECS recommended excavating the petroleum-impacted soil and transporting for disposal at an offsite permitted disposal facility. The closure laboratory results are summarized in Table 1. On October 14, 2021, ECS personnel observed and documented the excavation of approximately 17 tons of petroleum-impacted soils. ECS subcontracted Contaminant Control Inc. (CCI) from Salisbury, North Carolina to excavate, transport, and dispose of the impacted soils. Based on soil disposal manifests, 16.85 tons of petroleum-impacted soil was removed from the site and disposed at Alternative Energy Solutions (AES) of North Carolina located in Thomasville, North Carolina. The dimensions of the excavation were approximately 8 feet by 8 feet with an approximate depth of 6.5 feet bgs. Following removal of impacted soil, risk-based over-excavation soil samples were collected from the sidewalls and base of the excavation. No groundwater was observed in the base of the excavation. Based on the laboratory analytical results of the over-excavation soil analysis, petroleum impacted soil was not detected at concentrations exceeding the NCDEQ Soil-to- Groundwater or Residential MSCCs. The over-excavation laboratory results are summarized in Table 2. 2.0 SITE HISTORY The subject property is a residence located at 6106 Hucks Road in Charlotte, Mecklenburg County, North Carolina (Figure 1). The subject property is further identified by the Mecklenburg County GIS as Parcel Identification Number (PIN) 02718124. The approximate 50-acre subject property consists of a single-family residence, an associated storage building, open fields, a pond, and a stream. The residence was reportedly constructed in 1950 and contains approximately 1,486 square feet of space. ECS previously conducted a Phase I ESA for the subject property (ECS Project No. 49:12558, dated October 30, 2020). ECS noted the following REC in the Phase I ESA: • ECS considered the staining, stressed vegetation and petroleum odor indicative of a release beneath the AST located at the exterior of the storage shed to represent a REC based on the potential for impacts to the subject property. AST Closure & Initial Abatement Action Report Hucks Road Apartments 6106 Hucks Road Charlotte, Mecklenburg County, North Carolina NCDEQ Incident No.: Pending November 17, 2021 Page 3 Based upon the results of the Phase I ESA, MVP Equities Fund IV contracted ECS to conduct soil sampling activities at the site in an effort to evaluate if the identified REC has impacted the subject property. On August 27, 2021, ECS personnel mobilized to the subject property to collect soil samples beneath the AST. The approximate sample locations are indicted on Figure 2. Based on the analytical results of the soil samples, TPH-DRO was detected at concentrations greater than the NCDEQ Action Levels in one of the soil samples. Following the identification of the release, MVP Equities Fund IV recommended that the owners of the property report the incident to NCDEQ prior to them purchasing the property. It is our understanding that the previous property owner did not report the incident, therefore, the NCDEQ UST-62 (24-Hour Release and AST Leak Reporting Form) was completed and is included in Appendix A. 3.0 SITE GEOLOGY AND HYDROGEOLOGY As determined from the USGS Topographic Map, Derita, North Carolina Quadrangle dated 2019 (Figure 1), the site is at an approximate elevation of 843 feet above mean sea level. The closest surface water is an unnamed tributary and is located approximately 1500 feet northeast of the subject property. According to the Geologic Map of North Carolina, the site is located in the Charlotte Belt of the Piedmont Physiographic Province. The soils encountered in this area are the residual product of in-place chemical weathering of rock presently underlying the site and/or historic depositional events. In general, shallow unconfined groundwater movement within the overlying soils is controlled largely by topographic gradients. However, as the groundwater percolates downward, it becomes controlled by the subsurface geologic conditions. Thus, the direction of groundwater movement in the deeper aquifers may not be consistent with the reflecting topography. Recharge occurs primarily by infiltration along higher elevations and typically discharges into streams or other surface water bodies. The elevation of the shallow water table is transient and can vary with seasonal fluctuations in precipitation. Movement of shallow groundwater is generally from higher to lower elevations. Based on local surface topography groundwater is flowing to the south/southwest beneath the site. 4.0 AST REMOVAL ACTIVITIES 4.1 AST Removal ECS subcontracted CCI to remove the AST. On October 14, 2021, ECS observe and document the AST removal activities. Prior to removal, CCI removed the remaining liquids from the AST using a vacuum truck. Approximately 51 gallons of fluid were removed and disposed at the CCI facility in Thomasville, North Carolina. The fluids disposal manifest is included in Appendix B. Following removal of the remaining liquids, the AST was removed, loaded onto a truck, and disposed at the CCI facility in Thomasville, North Carolina. The AST disposal manifest is included in Appendix B and photo documentation of the AST removal activities are included in Appendix C. AST Closure & Initial Abatement Action Report Hucks Road Apartments 6106 Hucks Road Charlotte, Mecklenburg County, North Carolina NCDEQ Incident No.: Pending November 17, 2021 Page 4 5.0 INITIAL ABATEMENT ACTIONS 5.1 Petroleum-Impacted Soil Removal Actions On October 14, 2021, ECS personnel observed and documented the excavation of approximately 17 tons of soil by CCI. Based on soil disposal manifests, 16.85 tons of petroleum impacted soil was removed from the site and disposed at AES located in Thomasville, North Carolina. The soil disposal manifests are included in Appendix B. The final dimensions of the excavation were approximately 8 feet by 8 feet with an approximate depth of 6.5 feet bgs. The excavation was backfilled with off-site soils. Photographs of the field activities are included as Appendix C. 5.2 Risk Based Over-Excavation Soil Sampling Activities Following removal of impacted soil, risk-based over-excavation soil samples were collected from the walls and base of the excavation. One soil sample was collected from each sidewall of the excavation (OE-1 through OE-4) and one sample was collected from the base of the excavation (OE-5). The soil samples collected from the excavation sidewalls were collected at a depth of approximately 6 feet bgs. The sample collected from the base of the excavation was collected at a depth of approximately 6.5 feet bgs. Groundwater was not observed in the base of the excavation during collection of these soil samples. Soil sample locations are depicted on Figure 3. The soil samples were collected manually from the bucket of the excavator. Care was taken to obtain samples that did not come in contact with the excavator bucket. The samples were collected with a new pair of disposable nitrile gloves and placed into laboratory prepared containers. The soil samples were submitted for laboratory analysis of volatile organic compounds (VOCs) by EPA Method 8260, Semi-Volatile Organic Compounds (SVOCs) by EPA Method 8270, and Volatile Petroleum Hydrocarbons (VPH) and Extractable Petroleum Hydrocarbons (EPH) using the MADEP method. The samples were submitted under standard chain of custody (COC) protocol to Waypoint Analytical, LLC, a North Carolina certified laboratory located in Charlotte, North Carolina. 5.3 Risk Based Over-Excavation Soil Analytical Results Laboratory analysis of soil sample OE-4 detected C19-C36 aliphatic hydrocarbons at concentrations above the laboratory reporting limits but below the NCDEQ Soil-to-Groundwater and Residential MSCCs. Laboratory analysis of soil samples OE-1 through OE-5 detected acetone at estimated concentrations above the method detection limits but below the reporting limits (J-values) and below the Soil-to-Groundwater and Residential MSCCs. Acetone is a common laboratory contaminant and the detected concentration is likely a laboratory contaminant and not a result of the release. Laboratory analysis of soil samples OE-1 and OE-4 detected methyl ethyl ketone (MEK) at estimated concentrations above the method detection limits but below the reporting limits (J-values) and below the Soil-to-Groundwater and Residential MSCCs. The laboratory results of the over-excavation soil samples are summarized in Table 2. The laboratory reports and associated COCs records are included in Appendix D. AST Closure & Initial Abatement Action Report Hucks Road Apartments 6106 Hucks Road Charlotte, Mecklenburg County, North Carolina NCDEQ Incident No.: Pending November 17, 2021 Page 5 6.0 CONCLUSIONS AND RECOMMENDATIONS On October 14, 2021, ECS personnel observed and documented the excavation of approximately 17 tons of petroleum impacted soil from the site. Based on soil disposal manifests, approximately 16.85 tons of petroleum impacted soils were removed from the site and disposed at a permitted facility. Based on the results of over-excavation soil samples, petroleum impacted soil does not remain at concentrations above the NCDEQ Soil-to-Groundwater or Residential MSCCs. ECS recommends submitting this report to the NCDEQ UST Section for their review. Based on the results and the current NCDEQ regulations, NCDEQ should issue a Notice of No Further Action (NFA) for the incident.
