Dear Mr. Hudson,
The NC Division of Waste Management has received your notice of cease operation to close
the Septage Detention & Treatment Facility (permit #SDTF 12-03) & Septage Land Application Site
(permit #SLAS 12-03) located on SR#1796 in Burke County. The effective cease operation date was
November 7, 2023 and a final inspection has been performed.
As of this date, permits #SDTF 12-03 & #SLAS 12-03 have been closed out. If in the future
you wish to obtain a permit for a septage facility or land application site, please contact this office to
initiate the permitting process. Use of a septage facility or land application site that is not permitted
may result in administrative penalties up to $15,000 per violation in accordance with NC General
Statute 130A-22.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as maybe necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1) Currently, the Septage Land Application Site consists of approximately 63.5 acres that are available for
land application of domestic septage (including portable toilet waste) and grease septage. The site is divided
into four fields known as Field 1(21.4 acres), Field 2 (13.2 acres), Field 3 (21.5 acres), and Field 4 (7.4 acres)
and are established in fescue. This inspection was conducted as a closure inspection, at which time the fields
were not being used, the tanks were empty, and there were no intentions to use the fields moving forward.
Cease operation forms have been received by the Division.
2) Permitted septage types: Domestic septage, Portable toilet waste, Grease septage
3) 15A NCAC 13B .0842(a)(2): Required signage (No Trespassing, Septage Land Application.Site) was posted
at the entrance to the site.
4) 15A NCAC 13B .0842(a)(3): All weather roads are maintained as required.
5) 15A NCAC 13B .0842(a)(10): Boundary markers are present as required.
6) Quality of crop was good at the time of inspection.
