Spent peat filter material removed from on-site wastewater systems was stockpiled on the ground surface approximately 150 ft south of the detention facility. The items listed above are violations of the following rules. 15A NCAC 13B .0838 (e) Each detention and treatment facility shall be designed, constructed, and maintained to: (1) prevent leaks or the flow of septage out of the facility into the seasonally high water table, onto the ground surface, or into any surface waters; … 15A NCAC 13B .0838 (j)Septage shall be transferred to and from a detention system in a manner that prevents leaks or spills of septage onto the ground surface or exterior surface of the detention system, including septage in pipes used for transferring waste to and from vehicles. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and ADDITIONAL COMMENTS 1. An appropriate No Trespassing sign was displayed at the entrance to the site. 2. The tanks were accessible for inspection. 3. The visible portions of the tanks appeared structurally sound. 4. Septage transferals to and from the tanks appeared to be conducted in a way that left septage spilled on the ground, exterior surfaces of the tanks and in the roadway where the trucks park while loading and unloading. In these areas septage was observed on the exterior surfaces of the tanks the ground surface and accumulated between the tanks. One tank was overfilled to the extent that septage appeared to have run back out of the tank onto the ground surface. In an area adjacent to the facility approximately 150 ft south of the tanks, spent peat filter material removed from on-site wastewater treatment systems was observed stockpiled on the ground surface. The observations described are violations of 15A NCAC 13B .0838 (e) and (f) and are the subject of an accompanying Notice of Violation. 5. Objectionable odors were noticeable in the area of the facility. No Vectors were noticed in the area of the facility. 6. Approved setbacks appear to be met. 7. The access road was passable.
