OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0542(f)(2) states “Except as provided in Subparagraph (4) of this Paragraph, the owners and
operators of all C&DLF units shall cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and no less than once weekly. Cover shall be placed at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and scavenging, and to minimize fires
and the generation of odors. A notation of the date and time of the cover placement shall be recorded in the operating record as specified in Paragraph (n) of this Rule.”
The sloped area at/near the working face was observed to have no earthen cover material placed for some time. Facility staff stated they had been covering with ground mulch and facility is almost out of dirt in the borrow
pit..
2. 15A NCAC 13B .0542(l)(4) states in part “Leachate shall be contained on-site or treated prior to discharge”
15A NCAC 13B .0203(d) states “By receiving solid waste at a permitted facility, the permittee shall be
considered by the Department to have accepted the conditions of the permit and shall comply with the conditions of the permit.”
Part III, #43 of the approved permit states: The integrity and effectiveness of the cap system must be maintained. Maintenance and repairs to the cover must be conducted as necessary to correct the effects of settlement, subsidence, erosion, or other events, and to prevent surface water from impounding over waste, and run-on and run-off from eroding or otherwise damaging the cap system. Mowing and removal of trees on the final cover is required at least once per year.
Multiple leachate seeps noted on the northwestern side of the closed portion of the MSWLF(capped and closed
in 1998). Leachate was observed to have migrated nearly to the toe of the landfill slope and the stormwater ditch.
During landfill maintenance or during routine landfill inspections, staff should have observed and made attempts to correct these matters in accordance with the rules and permit.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. The facility is a Construction and Demolition (C&D) landfill on top of closed unlined Municipal Solid Waste
Landfill (MSWLF). 2. The facility is permitted to receive C&D waste, inert debris, asphalt, and land-clearing debris generated within Lenoir County.
3. The facility is fenced and is secured by a locking gate when it is not open for operation. 4. The correct signage is at the entrance of the facility listing the facility name, permit number and emergency contact information as well as materials accepted at the facility.
5. Personnel are onsite during operating hours. The C&D landfill is open to accept waste from 8:00 am until 4:00 pm Monday through Friday and 8:00 am until 12:00 pm on Saturday. The C&D debris landfill is normally closed on Sunday and select County holidays. 6. Facility records were not reviewed during this Facility Compliance Inspection. 7. A perimeter road has been established around the entire footprint of the landfill. The perimeter road is being well maintained. 8. The working face was appropriately sized for the expected waste. Waste is being well-compacted. Six inches of earthen material should be properly applied once weekly or when the working face reaches ½ acre.
9. Five tires were noted in the CDLF during inspection. Remove all unacceptable wastes from the CDLF working face and properly dispose of the unacceptable wastes. 10. At the conclusion of each operating day, all windblown material resulting from the operation shall be collected
and disposed of by the owner or operator. 11. Facility mowing scheduled for June. Remove any deep root penetrating vegetation that may voluntarily grow on the landfill such as small trees and brush.
12. Landfill Edge-of-waste markers installed and are being maintained around the landfill as required. 13. Monitoring wells are locked, capped, and properly tagged.
14. Small Type I composting area is also part of facility operations. The facility encompassing less than two (2) acres in size is permitted to process or store less than 6,000 CY of material per quarter in accordance with Rule 15A NCAC 13B .1402(f)(6). The facility is permitted to receive land clearing debris, yard waste, or wooden
pallet as defined in Rules 15A NCAC 13B, .0101(23) and .0101(56), and NCGS 130A-290(44a), respectively. 15. There is at least a 25 foot access path around the site for fire control vehicles. 16. All setbacks are in place.
17. Unpainted wooden pallets generated only from C&D activities shall be disposed of in the existing C&D landfill area, as they are received. Otherwise, wooden pallets are stored for chipping and mulching. The pallets that are chipped or mulched are immediately sold to contract haulers for use as
boiler fuel. The chipped/mulched pallets that are not immediately sold for boiler fuel are used for on-
site landscaping.
MSWLF(CLOSED)
18. The perimeter road around the inactive MSWLF(Phase 1) is be of all-weather construction and maintained in good condition. 19. The landfill cap is in good condition and is established with adequate ground cover over the majority of the site
at this time. Mowing scheduled for end of June. 20. The Edge of Waste Markers are in place and easily identifiable around the waste footprint of the facility. 21. Continue to monitor this site for erosion and additional leachate seepage.
22. Periodically remove any deep root penetrating vegetation that may voluntarily grow on the landfill such as small trees and brush.
23. Corrective actions are necessary to bring the landfill into compliance. A Notice of Violation letter will accompany this report and will outline the necessary actions.
