STATUS OF PAST NOTED VIOLATIONS:
Past noted violations were included in the Compliance Order issued to Macon County on February 1, 2024. Any
outstanding issues will be addressed outstanding issues will be addressed through resolution of the Order. resolution of the Order.
OBSERVED VIOLATIONS:
A. 15A NCAC 13B .1626(2)(b) states: "Except as provided in Sub -Item (c) of this Item, the owners or operators of
all MSWLF units shall cover disposed solid waste with six inches of earthen material at the end of each operating
day, or at more frequent intervals if necessary to prevent the escape of waste and the attraction of vectors and
scavenging, and to minimize fires and the generation of odors."
Macon County is in violation of 15A NCAC 13B .1626(2)(b) for failing to cover all disposed waste with six
inches of earthen material at the end of each day. On the morning of April 15, 2024, at 7:00 am, a pre -opening
inspection was conducted to ensure that all waste was being covered as required by 15A NCAC 13B .1626(2)(b).

An area of exposed waste measuring approximately 10'x45' was observed on the northeast side of the tarp being
used as alternative daily cover. Mr. Fowler stated he was on site on Saturday afternoon and that the exposed waste
had been covered by tarp, which had been weighted down by rocks. He further explained that the area had been
experiencing high winds for the past several days. Upon further inspection of the working face, a mattress was
observed protruding from the center of the exposed area. Mr. Fowler pointed out that the mattress might have
shifted creating a gap through which the tarp could be blown back.
To correct the violation, Macon County must cover all exposed waste in accordance with the rules at the
end of each operating day sufficient to ensure that waste remains covered until the next operating day given
local conditions. See comments below for more information Follow up inspections will be conducted to
ensure compliance with 15A NCAC 13B .1626(2)(b).
Exposed Waste on Northeast Side of Working Face
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photographs were taken on April 15, 2024, by Lee Hill.
2. The access roads were of all-weather construction and were being maintained at the time of inspection.
3. A pre -opening inspection was conducted to ensure that all waste was being covered as required by 15A NCAC
13B .1626(2)(b). An area of exposed waste measuring approximately 10'x45' was observed on the northeast side
of the tarp being used as alternative daily cover. Mr. Fowler stated he was on site on Saturday afternoon and that
the exposed waste had been covered by tarp, which had been weighted down by rocks. He further explained that
the area had been experiencing high winds for the past several days. Upon further inspection of the working face,
a mattress was observed protruding from the center of the exposed area. Mr. Fowler pointed out that the mattress
might have shifted creating a gap through which the tarp could be blown back. When the facility chooses to
utilize tarps for cover, the tarps should be adequately tied in with soil to surrounding areas and/or otherwise
weighted in a manner that prevents wind, precipitation, etc from moving the tarp. Further, if high winds are
forecast for the region, it may be necessary to cover the entire working face with six inches of soil cover instead
of using an approved alternative daily cover to ensure that the working face does not become exposed, allowing
waste to blow or the attraction of vectors.
4. The management of windblown waste showed significant improvement compared to the November 6, 2023,
inspection. However, windblown waste was observed on the east side of the landfill slope and against the litter
fencing, as well as in the ditch line on the west side of the landfill. Mr. Fowler noted that the area had been
experiencing high winds over the past several days, making it difficult to control windblown waste effectively.
He also indicated that he had community service workers on site picking up litter on Saturday. Additionally,
facility staff were also observed picking up litter on site later during the inspection. Please evaluate and
implement operational strategies where needed to address windblown waste in a proactive manner such as use
of movable physical fencing, more frequent cover of landfill on windy days, don't allow trucks to dump loads
into a prevailing wind, etc.
5. After the tarp was removed from the working face, no unapproved waste was observed.
6. The top of the landfill cell and the landfill side slopes were adequately covered throughout. However, two erosion
rills were observed in the cover: one on an interior slope adjacent to the working face and another on the south -
facing slope. Facility staff stated that addressing these erosion rills was one of the projects planned for completion
that day. They also mentioned that seeding of the side slopes and the cell top would be occurring in the next
couple of weeks.
