STATUS OF PERMIT:
A Permit to Operate a Land Clearing & Inert Debris Landfill Phase 1 and a Treatment and Processing Unit and a Permit
to Construct a Land Clearing and & Inert Debris Landfill Phase 1 Expansion was issued to Watauga County on June 27,
2012. The Permit to Operate shall expire on June 15, 2016.
PURPOSE OF SITE VISIT:

STATUS OF PAST NOTED VIOLATIONS:
15A North Carolina Administrative Code 13B .0566(2) states: “The facility shall only accept those solid wastes which
it is permitted to receive.”
General Permit Condition #6 states: “Construction and operation of this solid waste management facility must be in
accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North
Carolina General Statues (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan.
Should the approved plan and the rules conflict, the Solid Waste Management Rules shall take precedence unless
specifically addressed by permit condition.

The approved permit submittal for the land clearing and inert debris landfill (Document ID No. 12899) submitted to the
solid waste section on February 8, 2011 is included within the list documents that constitute the approved plan for the
facility. The subject document details the wastes accepted at the LCID landfill which are listed as stumps, trees, limbs,
brush, other naturally occurring vegetative material, unpainted concrete, unpainted brick, unpainted concrete block,
uncontaminated oil, asphalt, gravel, and rock. Therefore, these wastes constitute what is permitted for receipt at the
facility.

During the January 12, 2016 inspection, unacceptable waste streams were observed within the landfill consisting of
plastic, plywood, plastic construction fencing, PVC pipe, painted wood, corrugated plastic pipe, felt-like fabric, a piece
of metal conduit, and a 5-gallon plastic bucket. This material was concentrated at the western edge of the landfill with
the exception of the 5-gallon plastic bucket which was located at the toe of the slope on the south side of the landfill.
As a result, Watauga County was found in violation of 15A NCAC 13B .0566(2) and General Permit Condition #6.
Inspection of the facility on February 19, 2016 found that the unacceptable waste streams previously observed had been
removed and properly disposed as requested. Therefore, this violation is considered resolved. Thank you for your
cooperation in this matter.
OBSERVED VIOLATIONS:
No new violations observed.
ADDITIONAL COMMENTS
1. This was a follow-up inspection determine efforts taken to comply with the observed violations documented on the
previous inspection report issued on January 15, 2016. Please refer to “Status of Past Noted Violations” for
comments.
2. A gate was provided at the entrance to the facility to prevent unauthorized access.
3. Majority of the landfill was covered with soil at the time of the inspection.
4. The working face was less than one acre in size.
5. The access road was of all-weather construction and well maintained.
6. Edge of waste markers were in place at the time of inspection.
7. As noted on the previous inspection report, Gas Probe “TP1” has been installed and is being monitored quarterly.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
