This request was submitted on your behalf by Mr. Matt Ingalls of Hart & Hickman, PC (H&H) in his Stockpile Soil Characterization Report dated April 3, 2024. DEQ Brownfields reviewed the soil analytical data provided in the letter report. Based on our review of the data provided, the DEQ Brownfields agrees that these soils may be exported to Old 27 Landfill (Tate Street Mount Holly, Mecklenburg County, Permit No. 36-A-LCID). All soil export must be conducted under a DEQ Brownfields approved Environmental Management Plan (EMP). Per the EMP, the soils will be field screened during excavation prior to export from the property. If unanticipated impacts are identified during excavation, please refer to the EMP for further actions and cease transfer until appropriate characterization can be completed. In addition, in accordance with the Double Oaks Newland Avenue EMP, an annual Redevelopment Summary Report will be submitted to DEQ Brownfields. Details related to the disposition of this soil including but not limited to, total volume, general description of field screening efforts, etc. should be included with the Redevelopment Summary Report. Please be advised that this approval from DEQ Brownfields does not waive any applicable requirement to obtain any necessary permits, licenses or certifications which may be required from other state or local entities. Morehead Street #201 Charlotte, North Carolina, 28208 Attention: Avery Rogers Re: Soil Stockpile Characterization Report Double Oaks Brownfields Property 1302 and 1340 Newland Avenue Charlotte, North Carolina H&H Project No. BWR-013 Dear Avery: 1.0 Introduction and Background Information Hart & Hickman, PC (H&H) has completed soil characterization activities for disposal of approximately 2,000 cubic yards (CYs) of soil stockpiled at the Double Oaks Brownfields property located at 1302 and 1340 Newland Road in Charlotte, Mecklenburg County, North Carolina (Site). The Site has a completed Brownfields Agreement (BFA) with the North Carolina Department of Environmental Quality (DEQ) Brownfields Redevelopment Section (Brownfields Project No. 11037-07-060). A Site Location Map is attached as Figure 1 and the Site and surrounding area is shown in Figure 2. The Site consists of two parcels of vacant land (Parcel IDs: 07707902 and 07707903) that total approximately 5.6 acres. The Site is a portion of a larger Brownfields Property which is comprised of multiple parcels of contiguous and noncontiguous land that total approximately 56 acres. Most of the off-site portion of the Brownfields Property has been developed with a single-family residential subdivision (Brightwalk community) or multi-family apartment complexes (Alexander Apartment Avery Rogers April 3, 2024 Page 2 C:\Users\mingalls\AppData\Local\Microsoft\Windows\INetCache\Content.Outlook\UKB8DBGF\Stockpile Sampling Letter Report 2024_JDR Review.doc Homes and The Stevenson Apartments). The Site portion of the Brownfields property is currently under redevelopment of a townhome community and contains an approximate 2,000 cubic yard (CY) soil stockpile recently generated by NVR during construction activities. Redevelopment plans for the Double Oaks Brownfields property are being conducted in accordance with a DEQ-approved Environmental Management Plan (EMP) dated May 17, 2022. H&H understands that unsuitable soil generated from development activities has been stockpiled on-Site. H&H also understands that the stockpiled soil cannot be reused on-Site and will need to be exported. As such, H&H collected soil stockpile characterization samples to assist with identifying disposal facilities based on the analytical results of the soil stockpile sampling event. A summary of the stockpiled soil characterization activities is provided below. 2.0 Stockpile Sampling Activities Soil stockpile characterization activities were conducted on March 22, 2024 in accordance with the DEQ-approved EMP. The EMP states that soil samples will be collected at a rate of one (1) sample per every approximately 1,000-CYs for specified laboratory analyses mentioned below. Therefore, H&H divided the approximately 2,000 CY soil pile into two (2) 1,000-CY sample areas (Stockpile- A32224 and Stockpile-B32224). From each sample area, H&H collected five (5) aliquot soil samples from borings advanced within the stockpile from depths ranging from 0 to 7 ft using a decontaminated stainless-steel hand auger. During boring advancement, H&H inspected the soils, and allowed a portion of the soil sample to volatilize for field screening of volatile organic vapors using a calibrated photoionization detector (PID). During the stockpile sampling event, H&H did not identify obvious evidence of staining, unusual odors, or PID readings above background measurements in the aliquot soil samples. Sample locations are depicted on Figure 2. One grab sample was collected from an undisturbed portion of an aliquot soil sample collected in each evaluation area for a total of two (2) grab soil samples that were submitted to Waypoint Analytical, LLC (Waypoint), a North Carolina-certified laboratory for analysis of volatile organic Avery Rogers April 3, 2024 Page 3 C:\Users\mingalls\AppData\Local\Microsoft\Windows\INetCache\Content.Outlook\UKB8DBGF\Stockpile Sampling Letter Report 2024_JDR Review.doc compounds (VOCs) by EPA Method 8260. The grab samples collected for VOC analysis were selected based on results of field screening. Remaining portions of the five aliquot soil samples were homogenized to form a composite soil sample representative of each of the two stockpiles for a total of two composite stockpile samples. Composite soil samples were also submitted to Waypoint for analysis of semi-volatile organic compounds (SVOCs) by EPA Method 8270 and Resource Conservation and Recovery Act (RCRA) metals plus hexavalent chromium by EPA Methods 6020/7471/7199. Analytical results of the soil stockpile samples are discussed below. 3.0 Soil Sampling Results A tabular summary of the soil stockpile analytical results is presented in Table 1. Trace concentrations of the VOCs acetone [up to 0.033 milligrams per kilogram (mg/kg)] and ethanol (0.231 mg/kg) were detected in at least one stockpile sample above the laboratory method detection limits, but below DEQ Preliminary Soil Remediation Goals (PSRGs). Arsenic (up to 1.29 mg/kg) was detected in each soil stockpile sample above the Residential PSRG of 0.68 mg/kg, but within range of Site-specific background arsenic concentrations of 0.33 mg/kg to 2.0 mg/kg. Several other metals were detected in the soil stockpile samples above laboratory method detection limits that were either within range of or below established background metals concentrations. None of the other metals detected exceeded established PSRGs. The laboratory analytical report is provided in Appendix A. 3.0 Conclusions and Recommendations Based on the results of the Stockpile-A32224 and the Stockpile-B32224 soil characterization sampling activities, the Prospective Developer will request DEQ Brownfields approval to send the soil in Stockpile-A32224 and Stockpile-B32224 to a Land Clearing and Inert Debris (LCID) landfill (i.e., the Old 27 Landfill in Gaston County) or a Construction & Debris (C&D) landfill for disposal. In accordance with the EMP, we will ask that DEQ issues written approval for these disposal options based on the attached characterization information.
