PURPOSE OF SITE VISIT: Comprehensive Compliance Inspection
STATUS OF PAST NOTED VIOLATIONS:
A. 15A NCAC 13B .0542 (l)(4),(5) “Leachate shall be contained on-site or treated prior to discharge. A National Pollutant Discharge Elimination System (NPDES) permit may be required in accordance with 15A NCAC 02B prior to the discharge of leachate to surface waters. C&DLF units shall not: (A) cause a discharge of pollutants into waters of the United States, including wetlands, that violates any requirements of the Clean Water Act, including the NPDES requirements, pursuant to Section 402 of the Clean Water Act.” RESOLVED: “Corrective Action Sampling Report” dated July 5, 2023, “ --Revision 1” dated August 16,
2023, and “--Addendum 1” dated January 30, 2024 were submitted to and approved by the Section,

impacted soils were removed, and subsurface soils were satisfactorily sampled and analyzed. Elizabeth
Werner, Section Hydrogeologist, stated that no further action was required in a letter dated April 9, 2024.
ADDITIONAL COMMENTS This inspection was conducted both as a routine compliance inspection and as a follow-up visit to resolve the Notice of Violation issued on 4/19/2023. 1. The facility is fenced and is secured by a locking gate when it is not open for operation.
2. The interior roadways are of all weather condition and are maintained in good condition. During this inspection, a water truck was observed applying water to the paved sections of the road around the scale house. 3. The facility permit, operations plan, groundwater sampling records, LFG monitoring records, and staff training records were up to date and were reviewed with facility staff.
4. The following are certified facility personnel:

Recommend Mr. Burris renew his certifications prior to 2024 expiration dates.
5. Daily cover logs were verified up to 3/28/2024.
6. The inert debris stockpile contained no discernable non-conforming wastes and had been reduced in size
since the previous inspection, appearing to total less than 500 tons. 7. Vegetative cover on the side slopes and the top of the landfill provided adequate coverage in most areas and was mowed to an acceptable height. However, large sections of the southern and northern side slopes lacked vegetation at the time of this inspection, and erosion rills were present on the southern side slope. Mr. Jones
stated that the side slopes had recently been regraded, causing the lack of vegetation, but that all areas had
been seeded in preparation for warmer weather. Continue to ensure that vegetative cover is established and maintained on all landfill side slopes and that any erosion rills are repaired as soon as they are observed, and conditions allow. 8. At the time of this inspection, perimeter storm water drainage ditches along the base of the southern and
northern side slopes were inundated with sediment, due in large part to the lack of vegetation noted in #7.
Mr. Jones emailed pictures (included on Page 5) to Mr. Davis on 4/9/2024 showing that the drainage ditches had been dredged of sediment and that rip rap check dams had been installed. Continue to ensure that perimeter storm water drainage ditches are repaired/dredged as needed, provided vegetative cover, and maintained.
9. The working face was compact and appeared to be below ½ acre in size.
10. Windblown waste was being properly managed, and the facility grounds were generally clean and free of windblown waste.

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

11. Permanent edge of waste markers (EOW) were observed around the landfill and are adequately spaced so
that each one is visible to the next. 12. The landfill gas (LFG) flare south of the landfill, non-operational during the previous inspection, is now operational and in use. 13. The composting area (9230-COMPOST) currently accepts approximately 50 incoming loads (8 cubic
yds/load) per month of grass and leaves from the Town of Apex. Temperature logs were not verified during
this inspection. This site should be managed in accordance with the rule requirements for Type I compost facilities and the approved Operations Plan. 14. During this inspection, ponding water was observed within the compost operations area and at the base of some of the compost windrows. Ensure that the compost operations area is graded so that stormwater is
diverted and prevented from ponding.
15. The compost area also contains a land clearing debris pile which is ground approximately two times per year and used solely on the landfill property. 16. Digital photographs were taken during this inspection.
