Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
On April 4, 2024, Chuck Kirchner met with Sean Murray to conduct a comprehensive inspection of the Sean Murray Grading Yard Waste Notification on Lystra Road in Chapel Hill, Chatham County.
1. The yard waste notification (YWN) is located atop a portion of a notified land clearing and inert debris (LCID) landfill (N0193) that has been covered with soil and is no longer in operation. 2. The property (parcel No.: 67592) is owned by Mark Anthony Laney as of December 18, 2022. The property owner contact listed on the current YWN facility renewal form is Council Land Holding (ph. 919-485-9917). 3. The facility is posted ‘not open to the public’. Scott Murray Grading, Inc. uses the YWN/property for its business. 4. Mulched woody material and land clearing inert debris observed on site in an area less than ¼ acre. A small pile of yard trash observed on site that Mr. Murray stated is used exclusively to stabilize the roadbed of the facility. 5. Adequate equipment observed on site for all YWN needs. 6. Mulch is available to the public. 7. Mr. Murray stated that there was ~ 3000 cubic yards of mulch on site.
8. Material accepted is required to be less than 6,000 cubic yards quarterly, processed and unprocessed combined. 9. The operation must remain < 2 acres in size. 10. The facility appeared to meet required setbacks.
11. Recommend keeping a fire access lane around all sides of LCD/mulch material in case of fire. 12. Soil is stockpiled for reuse adjacent to the YWN operation. The soil is used by Sean Murray Grading, Inc. 13. Concrete and rock are stored for reuse at the far end of the lot. The concrete and rock are used by Sean Murray
Grading, Inc. 14. No erosion or runoff was observed during this inspection. 15. Access roads are of all-weather construction. 16. The site is secured by a chain gate with lock. 17. The facility has a good sign. Recommend including contact information in case of fire during closed hours. 18. The yard waste facility notification shall be renewed annually by June 1st.
