PURPOSE OF SITE VISIT: Partial Inspection STATUS OF PAST NOTED VIOLATIONS: NONE OBSERVED VIOLATIONS: NONE
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any

ADDITIONAL COMMENTS
1. The facility is a notified land clearing and inert debris (LCID) landfill. The disposal area for notified LCID landfills shall remain under two acres.
2. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and asphalt. 3. This facility also has a Type 1 Yard Waste Notification. It accepts tree limbs, untreated wood, leaves, grass clippings, brush, shrubs, and other yard trimmings.
4. Reminder Yard Waste Notification Facility Renewal forms are due annually prior to June 1 each year.

5. The facility is properly secured with a locked gate. 6. Access roads are of all-weather construction. 7. Buffers are being maintained.
8. Per 15A NCAC 13B .0566 (1) states that “The site shall only accept those solid wastes that it is permitted
to receive.”
Unacceptable waste streams were noted during the inspection. Creosote poles and treated lumber need to be removed and properly disposed of at a facility permitted to accept that waste type. Operator explained the facility was aware of the unacceptable waste and had already contacted the contractor that dumped the unacceptable waste to have it removed from the site.
9. Onsite discussion included closing and the possibility of permitting the NLCID. Ms. Patterson re-sent Mr. Benford new NLICD rules via email with this inspection report. The new rules have eliminated Notified LCID landfills. This site must close by January 1, 2026. The only way to continue operating would be to get this site permitted. Deana Yitbarek is the permitting engineer with the Section for New Hanover County and she should be contacted for questions on permitting. Her contact info is (919) 707-8234 and diana.yitabarek@deq.nc.gov. Property owners of the NLCIDLF after January 1, 2026 will need to follow
Closure and Post Closure Care rules .0567.
