(F&R) has prepared this Stream Access Control Workplan on behalf of Greystar Development with regard to the Subject Property. The redevelopment is being completed in accordance with the North Carolina Department of Environmental Quality (NCDEQ) approved Environmental Management Plan (EMP) for the three parcels located between Yeoman Road and Verbena Street in Charlotte, Mecklenburg County, North Carolina, herein referred to as the Brownfields Property. The Brownfields Agreement for the Brownfields Property was recorded on September 19, 2023. 1.0 BACKGROUND In accordance with subparagraph 13.k of the Brownfields Agreement this constitutes the plan for controlling access and/or use of the on-site surface water feature to be approved and implemented prior to occupancy. This workplan covers the ongoing access and does not cover the redevelopment activities conducted pursuant to the EMP. 2.0 STREAM ACCESS CONTROL WORKPLAN As outlined in Brownfields Agreement, subparagraph 13.b which is final and has been recorded: No occupancy or opening of the Brownfields Property for any on-site activities shall occur unless a plan for placing appropriate controls that prevent access and/or use of the on-site unnamed tributary to Irwin Creek as denoted on the survey plat component of the Notice of Brownfields Property referenced below in paragraph 17 is submitted and implemented to DEQ’s written satisfaction. Such a plan may include, without limitation, physical barriers such as fencing, and/or the posting of signs prohibiting activities that Verbena Street Assemblage (AJACC Auto) Stream Access Control Workplan Verbena, Macie, and Yeoman Street F&R Project No. 59Z-0029 Charlotte, North Carolina 2 April 3, 2024 include fishing, wading, swimming, and boating. Such plan shall be implemented within 30 days after written approval of DEQ is granted. Access will be controlled via signage. Signs will be placed on both sides and on each end of the unnamed tributary where it traverses the Subject Property. The signs will be placed so they are visible to person(s) approaching the stream. A total of five (5) signs are proposed. The signs will have the following wording: “Caution: Fishing, wading, swimming, and boating is prohibited.” F&R and Greystar note that the tributary is too small to permit boating, but the restriction will be included on the signs. 4.0 CLOSING The signs will be placed, and photos documenting the placement of the signs will be submitted to the NCDEQ within 30 days of approval of this plan.
