STATUS OF PERMIT:
A Permit to Operate a Land Clearing & Inert Debris Landfill Phase 1 and a Treatment and Processing Unit and a Permit
to Construct a Land Clearing and & Inert Debris Landfill Phase 1 Expansion was issued to Watauga County on June 27,
2012. The Permit to Operate shall expire on June 15, 2016.

OBSERVED VIOLATIONS:
15A North Carolina Administrative Code 13B .0566(2) states: “The facility shall only accept those solid wastes which
it is permitted to receive.”
General Permit Condition #6 states: “Construction and operation of this solid waste management facility must be in
accordance with the Solid Waste Management Rules, 15A NCAC 13B, Article 9 of the Chapter 130A of the North
Carolina General Statues (NCGS 130A-290, et seq.), the conditions contained in this permit; and the approved plan.
Should the approved plan and the rules conflict, the Solid Waste Management Rules shall take precedence unless
specifically addressed by permit condition.

The approved permit submittal for the land clearing and inert debris landfill (Document ID No. 12899) submitted to the
solid waste section on February 8, 2011 is included within the list documents that constitute the approved plan for the
facility. The subject document details the wastes accepted at the LCID landfill which are listed as stumps, trees, limbs,
brush, other naturally occurring vegetative material, unpainted concrete, unpainted brick, unpainted concrete block,
uncontaminated oil, asphalt, gravel, and rock. Therefore, these wastes constitute what is permitted for receipt at the
facility.
During the inspection, unacceptable waste streams were observed within the landfill consisting of plastic, plywood, plastic
construction fencing, PVC pipe, painted wood, corrugated plastic pipe, felt-like fabric, a piece of metal conduit, and a 5-
gallon plastic bucket. This material was concentrated at the western edge of the landfill with the exception of the 5-gallon
plastic bucket which was located at the toe of the slope on the south side of the landfill. As a result, Watauga County is in
violation of 15A NCAC 13B .0566(2) and General Permit Condition #6.

To achieve compliance, within 30-days of issuance of this inspection report, all unacceptable wastes must be removed
from the LCID landfill and properly disposed.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The facility is permitted to receive solid waste generated within Ashe, Avery, Caldwell, Watauga and Wilkes
Counties.
2. The permit and operations plan were current and available upon request.
3. A gate is provided at the entrance to the facility to prevent unauthorized access.
4. The working face was less than one acre in size at the time of inspection.
5. Surface waste was diverted from the working face. No stormwater ponding was observed in the landfill.
6. Majority of landfill was covered with soil at the time of inspection.
7. The access road was of all-weather construction and well maintained.
8. Edge of waste markers were in place at the time of inspection.
9. The previous inspection report required that Stage 1 of the approved landfill gas monitoring plan be implemented.
Since the previous inspection, Gas Probe “TP1” has been installed since the last inspection and is being monitored
quarterly.
x Methane monitoring was being performed in conjunction with monitoring events associated to the closed
MSWLF. Records for sampling events performed on 8/5/14, 11/4/14, 2/12/15, 5/26/15, 8/5/15, and
11/4/15 were verified. No exceedances above applicable limits were found.
Operations Inspection of the Treatment and Processing Unit:
10. The facility is permitted to receive wooden pallets, constructed of unpainted and untreated natural wood, land
clearing debris as defined by 15A NCAC 13B .0101(23), and yard trash as defined in 15A NCAC 13B .0101(55).
11. Pallets and unground land clearing debris were being placed into separate stockpiled at the time of inspection.
12. Grinding operations are conducted twice per year
13. During the inspection, multiple pieces of oriented strand board (OSB) were observed in the pallet pile.
x The approved Operational Manual for the facility states: “Engineered (glued) wood products shall not
be managed in this area.”
x Mr. Potter explained that the pallets and engineered wood are ground for boiler fuel only, and are not
distributed to the public.
x As the engineered wood is designated for boiler fuel, the acceptance of this material will not be considered
a violation at this time. During the next permitting cycle for the facility, Watauga County must modify the
Operations Manual to clarify this material collected and staged separately for use as boiler fuel, or the
facility must immediately cease acceptance of this material.
14. The facility is permitted to operate a Type 1 compositing unit.
x During the inspection, one small pile of leaves was observed on the southwest portion of the landfill.
Loads of leaves were also observed deposited within the designated area for disposal of land clearing
debris. Mr. Potter explained that leaves are normally ground with the land clearing debris for mulch.
x As noted on the previous inspection report, any yard trash (solid waste resulting from landscaping and yard
maintenance such as brush, grass, tree limbs, and similar material) must be segregated for composting,
including yard trash from seasonal leaf collection that is accepted by the facility. Ground material
containing yard trash may not be distributed unless it has been composted in accordance with Rule .1400.
x Therefore, all yard trash including leaves must be segregated and properly composted. As required
by 15A NCAC 13B .1406(10), the compost process shall be maintained at or above 55 degrees Celsius
(131degrees F) for 3 days and aerated to maintain elevated temperatures. Documentation of
temperatures must be provided to the Solid Waste Section upon request.
15. Waste was being maintained into reasonably sized piles at the time of inspection.
16. No objectionable odors were observed.
17. No significant ponding was observed within the operational area.
18. The access road leading to the Treatment and Processing Unit was of all-weather condition and well maintained.

19. Good access was provided around piles of material to allow for access by firefighting equipment.
20. As noted above, the Permit to Operate for this facility expires on June 15, 2016.
