I added the soil and seed to the area. The soil was purchased from lowes and the bag's in thepicture for reference. Please see the attached pictures. Please let me know if you have any
questions.

Yes, it is appropriate to backfill with virgin topsoil from a reputable commercial source. This soilwould not need to be sampled for import. The soil should not come from a corner lot with soil for
sale, if you do so that route, we need to sample prior to placement. Purchasing from Lowes, HD,or Ace hardware for soil is a simple solution. Adding seed and water for grass will solve the issuecompletely.
Once the work is complete, please send update and photos. Thank you for your attention to thismatter.

Hi Carolyn,
Mark forwarded me the site inspection report for the property, and I see that there is an
issue regarding the excavation around the footer for the pavilion roof. I am sorry that I
didn't notify you of that before any work started. There had always been a stage on theground, but the roof structure was added after, in 2022. I am proposing to backfill that
area with topsoil to make the area flush with the surrounding grade, and then plant grassseed. Can you please let me know if you feel that is sufficient to refill that area?

On Wednesday, January 24, 2024, Mr. Kevin Slaughter from the Brownfields
Redevelopment Section (BRS) visited the Precision Dynamics Brownfields Propertylocated at 1033 Carter Avenue in Charlotte for purposes of a brownfields inspection. As
an officer of TPM Properties Limited Partnership (the Owner of Record of the PrecisionDynamics Brownfields Property), DEQ BRS is making you aware of the results of that
inspection, and the corresponding Site Inspection Report (SIR) which can be viewedusing the link provided below.

1. Although a Land Use Restriction Update (LURU) was submitted for 2023, it does
not appear that the January 2024 LURU has been submitted to the BRS yet. If thisis the case, please complete the LURU, have it notarized, and forward it
to <BFPropertyManagement@deq.nc.gov> as soon as possible.
2. During the Site inspection, it was noted that an open-air wood pavilion had been
constructed on the western portion of the property without DEQ knowledge, which
is a violation of Land Use Restriction (LUR) 5, which states the following:
LUR 5: After conclusion of the redevelopment period referenced in paragraph 3 above, as
determined by DEQ, no activity that disturbs soil on the Brownfields Property may occur
unless and until DEQ states in writing, in advance of the proposed activity, that said
activity may occur if carried out along with any measures DEQ deems necessary to
ensure the Brownfields Property will be suitable for the uses specified in LUR 1 above
while fully protecting public health and the environment, except that the Prospective
Developer need not obtain approval if such activity is conducted in accordance with the
EMP. Notwithstanding the above, the Prospective Developer may conduct landscaping
activities including without limitation mowing, pruning of above-ground vegetation, and
landscape plantings (providing total depth of the final soil cover is not compromised and
the work does not penetrate into impacted soils), as well as emergency repair of
underground infrastructure, provided that DEQ shall be given written notice (if only by
email) of any such emergency repair no later than the next business day, and that any
related assessment and remedial measures required by DEQ shall be taken.
3. In addition, a partial excavation was observed around the wood pavilion's front right
support footer as can be seen in Photo 4 of the SIR. This is also covered byLUR:5, and this excavation could potentially allow contact with impacted soil
located below the layer of clean cover. This excavated area should be refilled flushwith the surrounding grade. Depending on the type of material selected for filling,
testing of import may or may not be required. Let us know what your proposedmethod is, and we will evaluate prior to the excavation being refilled.
In 2019, I exchanged emails with Kurt Logan for soil disposal options as it relates to this
property. Was the structure installed during this time frame? I do not have records ofnotification for construction. The pavilion does not need to be removed or moved,
however, soils should be to level the area added as stated. In addition, this is a reminderto notify DEQ BRS when disturbing the ground.
