STATUS OF PERMIT:
Permit To Operate Areas 1-6 & Permit to Construct Areas 7 and 8 issued March 10, 2021; expires September 22, 2025. PURPOSE OF SITE VISIT: Tax Certification Inspection and Partial Compliance Inspection STATUS OF PAST OBSERVED VIOLATIONS:
A. 15A NCAC 13B .0101 (28), “’Inert debris waste’ means inert debris that consists solely of asphalt, cured concrete, brick, concrete block, gravel, and rock. Inert debris waste shall not contain chemical adhesives or sealants, or lead-based paint.”
RESOLVED: The inert debris disposal area on the northside of the facility was observed to be relatively free of the commingled/unacceptable wastes identified during the previous inspection. Continue to ensure that incoming waste loads are visually inspected prior to disposal and that any unacceptable loads or materials are rejected. Any previously disposed commingled/unacceptable wastes uncovered during daily operations should be immediately removed and disposed of offsite at a permitted facility. B. 15A NCAC 13A .0566 (2), “Solid waste in the landfill shall be compacted. Slopes shall not exceed a ratio of three horizontal to one vertical at any time.”

PARTIALLY RESOLVED: The northside slope of the landfill containing inert debris has been re-graded to achieve a ratio closer to three horizontal to one vertical (3:1). However, additional cover soil is needed on the eastern end of the northside slope and inert debris waste was still present within the tree line. Ensure that all inert debris waste is removed from within the tree line, returned to the disposal area, and covered properly.
ADDITIONAL COMMENTS A revised Operations Plan was submitted to the Division on 11/15/2023 by Smith Gardner, Inc, but is not yet approved. 1. Posted entrance signs continue to lack some pertinent information such as hours of operation, contact name, and stating no hazardous waste or liquid waste can be received at the facility. In addition, no traffic signs or markers were observed during this inspection. Mr. Everett stated that new signs have been ordered but was unsure of the status of
the order. Ensure posted entrance signs contain all required information as stated in the Permit. Traffic signs or markers must be utilized to ensure safety and efficiency. 2. A copy of the facility permit was printed and made available during this inspection. A copy of the revised 2023
operations plan, which has not yet been approved, was also made available. Mr. Davis emailed a copy of the currently approved 2020 operations plan to Mr. Everett on 2/15/2024. 3. Interior roadways were of all-weather construction, maintained in fair condition, and all were passable to vehicular
traffic. Partially hardened concrete was again observed to be dumped adjacent to and on top of facility roads and in some instances left to cure in untended mounds. Mr. Everett again stated that this concrete was supposed to be applied to the facility roads and spread evenly by facility staff but was left in mounds by mistake. Continue to ensure that partially hardened concrete is accepted and managed according to the approved operations plan. 4. Permit to Operate, Attachment 3, Part V (6), “Solid waste must be restricted to the smallest area feasible, compacted densely as practical into cells by proper construction equipment.” At the time of this inspection, multiple areas of the facility contained uncovered and/or stockpiled waste. Active disposal areas were identified on the western and eastern portions of the landfill, and a large section of uncovered concrete waste was identified in the northeastern section. Large piles of land clearing debris, multiple segregated log piles, and piles of soil mixed with woody waste were identified in various locations throughout the landfill. Ensure that waste disposal is restricted to the smallest area feasible and covered with no less than six inches of soil. Stockpiling of materials should be restricted to designated areas as outlined in the approved operations plan. 5. Permit to Operate, Attachment 3, Part V (8), “Permanent markers that accurately delineate the waste disposal boundary must me maintained.” At the time of this inspection, no edge of waste (EOW) markers were in place.
Ensure that EOW and property line markers are installed. 6. Trees have been removed from the northern and eastern side slopes and mowing occurred in May 2023. Some woody vegetation was observed on the western side slope during this inspection. Continue to ensure that woody vegetation is
removed or rough cut, and that vegetative cover is mowed as needed. 7. 15A NCAC 13B .0564 (7), “The site shall establish and maintain an access road around the waste boundary for access by emergency or fire fighting vehicles or equipment.” The partial access road identified in the previous
inspection has undergone no discernable improvements or expansion. Ensure an access road around the waste boundary is established as required by rule and permit. 8. During this inspection, large pieces of concrete infused with and attached to corrugated scrap metal was identified alongside the eastern interior access road. Countertop waste was also identified on the eastern interior access road. Concrete infused with scrap metal and countertop waste does not meet the definition of inert debris. Ensure that all unacceptable materials are removed from the facility and disposed of at a facility permitted to accept such wastes. 9. At the time of this inspection, the stormwater drainage channel along the toe of the southern and western side slopes was inundated with sediment. A portion of a slope drain on the southwestern slope had become detached and was

Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

submerged in the sediment. Also, the access road in these areas contained large erosion rills and damage sustained from stormwater. Ensure that slope drains are repaired, and stormwater drainage channels are cleaned of sediment and maintained as designed to ensure they function properly. The access road should be repaired/re-graded as needed and maintained. 10. At the time of this inspection an approximately 30-foot-tall stockpile of concrete waste was identified in the southern portion of the landfill property. Mr. Engler stated that this material was periodically crushed as needed. Ensure that
incoming/stockpiled concrete waste is crushed as often as necessary to ensure material is either reused or disposed of within 1 year of acquisition in accordance with the General Statute 130A-309.05 (c)(1). 11. Corrective measures are necessary for this facility. 12. Digital photographs were taken during this inspection.
