Permit to Operate No. 0106-TP-2012 ATTACHMENT I, PART I, General Facility Permit Condition # 5 states: “In accordance with Rule 15A NCAC 13B .0203(d), by receiving waste at this facility, the permittee shall be considered to have accepted the conditions of this permit and shall comply with the conditions of permit.”

a. Permit to Operate No. 01-06-TP-2012 ATTACHMENT III, PART VI, General Facility Permit Condition # 6 states in part: “The facility has the approved operation and storage areas as shown on
Figures 1 through 3 of the approved plan (FID 1784061). The approved maximum capacity of combining untreated/unprocessed wastes and products stored at the facility is 6,000 cubic yards
(CY).” On February 26, 2024, an accumulation of LCID waste was observed stockpiled throughout the facility property. The total
volume of untreated/unprocessed wastes and mulch products stored at the facility was measured to be at least 23,585 cubic yards. Therefore, Carolina Resource Recovery, Inc. is in violation of 15A NCAC 13B .0203(d). To achieve compliance the volume of untreated/unprocessed wastes and products stored at the facility must be reduced to less than 6,000 cubic yards.
ADDITIONAL COMMENTS
On February 26, 2024, Chuck Kirchner met with Sonya Heath and Stacey Bradsher to conduct a comprehensive inspection of the Carolina Resource Recovery, Inc. Treatment and Processing Facility on Jones Drive in Mebane, Alamance County.
1. Carolina Resource Recovery, Inc. is a land clearing debris (LCD) treatment and processing (T&P) facility. 2. The facility is located a few hundred yards down the road from Scott Stone, Inc. 3. The facility is operated by Mebane Wood Recycling personnel: Stacey Bradsher, Owner. Mr. Bradsher and Ms. Heath stated that Mr. Porter and Mr. Pedneau are no longer involved with this facility. 4. There is a portable office located at the facility entrance. The office manager is Sonya Heath. The office phone number is: 336-512-1229 (PO Box 1631, Mebane, NC 27302). 5. The facility permit, site plan, and operations plan were discussed. An updated copy of the permit is needed in the office. 6. The facility is permitted to receive LCD, untreated and unpainted wood waste, uncontaminated pallets, and uncontaminated soil. 7. The facility is composed of a soil screening area, LCD storage, processing, and load-out area, and a temporary debris storage and reduction site (TDSR). 8. The facility generally accepts material from: Alamance, Durham, Guilford, Orange, Person, and Wake Counties.
9. Land clearing debris is converted using a factor of 400 pounds per cubic yard or 0.2 tons/yd3 by the facility. 10. The following stockpiles were measured to have the following cubic yardage: In the south side stockpile area the LCID stockpile was 8,055CY, Mulch pile – 777CY, Adjacent mulch pile – 2,083CY, Stump pile – 1,527CY, logs – 667CY. In the north side stockpile area – LCID stockpile – 6,500CY, logs – 133CY, smaller mulch pile – 194CY, larger mulch pile – 1,851CY. There were also three mulch stockpiles located on the west side of the property that Mr. Bradsher stated was contaminated with soil. These three stockpiles measured 1,125CY, 583CY and 90CY. In addition, there were other stockpiles that were not measured during this inspection. The facility is permitted to have up to 6,000 cubic yards of untreated/unprocessed land clearing debris waste and mulch products stored at the facility. The facility currently has four times the permitted limits for material on site. See violation above. 11. Incoming loads need to cease. Mr. Kirchner informed Mr. Bradsher during the inspection that incoming loads need to cease until the site is under the permitted limit of 6,000 cubic yards. See violation above.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

12. During the inspection a transfer trailer was loaded with mulch and taken off site. Mr. Bradsher stated that one to
two transfer trailers are currently taking mulch off site at the rate of 300-600 cubic yards per day. 13. No yard trash or leaves were observed during this inspection. 14. Storage of pre-processed permitted wastes must be limited to an average of 14 feet high and 30 feet wide at the base, unless otherwise approved by the Section. 15. All windrows shall be separated by a minimum of 20 feet. 16. Storage of finished product shall be in rows averaging 10 feet wide, 15 feet between windrows and 20 feet around the exterior of the windrows. 17. A 50-foot buffer shall be maintained around the boundary of the processed/unprocessed material and any drainage features or property lines. 18. The current state of the facility poses a significant fire hazard. If one of the stockpiles caught on fire it would be
very difficult to get it out. Fire equipment should be able to access all sides of the material at any time. 19. Ensure stockpiles are not pushed right up to the woodline. 20. Ms. Heath displayed the database she uses to keep track of incoming and outgoing loads of LCD. The facility accepted no material and sold 80 tons in December of 2023 and neither bought nor sold any material in January of 2024. 21. The facility annual report (FAR) for July 2022 through June 2023 was received by the SWS, dated August 1, 2023. The facility received 6,919 tons of LCID solid waste from Alamance and Orange County in that time. 22. Only LCD material was observed on site. 23. About half of the LCD material on site had been processed into mulch. 24. No grinding of mulch was taking place at the time of this inspection. 25. The facility has conditional approval for a TDSR (Temporary Debris Storage and Reduction) number: DS01-001. 26. The area allotted for the TDSR is 4.8 acres: 2.4 acres cleared and 2.4 acres treed. 27. If the facility plans to operate the TDSR due to a disaster event the facility shall notify the SWS prior to
accepting material in the TDSR. Material accepted at the TDSR must be removed within six months of receipt. 28. No erosion or runoff was observed.
29. Open burning of solid waste is prohibited at the facility. 30. Fires shall be reported to the Division orally within 24 hours of the incident and in writing within 15 days of the incident. Standard fire reporting form is in the operations plan. 31. The Alamance County Volunteer Fire Department and the Mebane Fire Department can be contacted to respond to an emergency at the facility. 32. The facility is secured by a locked gate. 33. The facility has proper signage.
