STATUS OF PAST NOTED VIOLATIONS:
A. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(4)(a) states: "Owners or operators of
MSWLF units shall ensure that: (i) the concentration of explosive gases generated by the facility does not
exceed 25 percent of the lower explosive limit in on -site facility structures, excluding gas control or recovery
system components; and (ii) the concentration of explosive gases does not exceed the lower explosive limit at
the facility property boundary."
On January 26, 2023, Rockingham County was in violation of 15A NCAC 13B .1624(a)(ii) for failing to ensure
that concentration of explosive gases does not exceed the lower explosive limit at the facility property
boundary. Landfill gas monitoring records show historical exceedances of methane at the boundary probes

7901-M-3, 7901-M-4, 7901-M-5, 7901-M-8A, 7901-M-11 and 7901-M-12. The January 27, 2023, sampling
event reported an exceedance in gas probe 7901-M-5; the level of methane detected was 47.7 percent by
volume. The facility is currently developing plans to address the exceedances.
OBSERVED VIOLATIONS:
None.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
ADDITIONAL COMMENTS
1. The permit for this facility includes the following operations: active MSW landfill, scrap tire collection, white
goods collection and processing, compressed gas cylinder collection, electronics and TV collection, wood waste
collection and processing, inert debris collection and processing, and a convenience center for the drop-off of
residential wastes and single stream recyclable materials.
2. Rockingham County has contracted the operation of the landfill to Wall Recycling. A letter submitted by
LaBella Associates on behalf of Rockingham County on June 5, 2023, provides a revision to the
application to change the landfill operator to Wall Recycling.
3. A landfill gas plant owned and operated by the county is located on the southeast side of the leachate pond. The
plant is not currently producing electricity, and all gas is routed to the flare.
Records Review:
4. Facility Permit to Operate and Operations Plan are kept on site in the maintenance building.
5. The Facility Annual Report for 2022-23 was reviewed and indicated that the facility received 121,625 tons of
waste. The facility is permitted to receive approximately 96,500 tons during the fiscal year. A letter submitted
by LaBella Associates on behalf of Rockingham County on June 5, 2023, provides a revision to the
application to increase the approved annual disposal rate of landfill. Ensure that the annual disposal rate
meets the current approved Permit to Operate.
6. Facility monthly tonnage records were provided for review. The records indicate that the facility has accepted
63,735.97 tons of waste from July 2023 through December 2023. This shows an average of 10,622 tons per
month which indicates that the facility is on pace to receive 127,471 tons in this fiscal year. Rockingham
County has an approved yearly acceptance of 96,500 tons; however, Rockingham County has submitted a
change to increase the approved tonnage.
7. Processed white goods and scrap metal are collected on site and shipped to Wall Recycling facility for
processing. White good records were provided by email following the inspection.
8. The facility no longer uses RNG for the removal of CFCs from white goods and instead uses certified facility
staff for the removal of CFC's. CFCs removal records were provided for review from July 10, 2023, through
January 12, 2024.
9. Scrap tire records were provided and reviewed for the months of March 2023 through January 2024.
10. Facility electronics recycling records were provided for review from March 2023 through January 2024.
11. Incoming loads are randomly selected for inspection as required by permit. Waste screening records are stored
on site and were provided for review. Records from March 2023 through January 2024 were reviewed and
found to be complete.
12. Leachate hauling records for the facility were provided for review from March 2023 through February 5, 2024.

13. Groundwater monitoring takes place twice annually as required by the permit. The most recent report from
October 3, 2023, was reviewed.
14. Landfill gas monitoring takes place on a quarterly basis as required. The facility conducts gas monitoring events
monthly to monitor the methane exceedances at the boundary gas probe. Please see the Status of Past Noted
Violations section of this report for more information.
15. On January 17, 2024, Robert Pike and Ervin Lane, Hydrogeologist, met with representatives of Rockingham
County, Wall Recycling, and Labella Associates at the Rockingham County Landfill to discuss proposals to
address the exceedances at the property boundary. On January 26, 2024, Labella Associates stated that the gas
probes where the exceedances are occurring were too deep for the trench to work and that LaBella Associates
were continuing to explore a solution to address the issue. During the site inspection on February 6, 2024,
LaBella Associates stated that a new proposal to install soil vents was under review to be submitted to Mr.
Lane.
16. Training records for the facility staff were reviewed:
a. Dan Jarboe, Manager of Landfill Operations Certification No. 1851659, expires 09/05/2024.
b. Charlie Jarboe, Manager of Landfill Operations Certification, expires November 1, 2025.
c. Jeff Ikerd, Manager of Landfill Operations Certification, expires 12/03/2025.
Field Inspection:
17. Proper signage was observed at the facility entrance.
18. Facility access roadways are of all-weather construction and in good condition.
19. The facility was observed to be clean and well maintained. Windblown litter was observed to be minimal with
litter pick-up crews actively picking up any windblown litter on site.
20. The convenience area was found to be clean and well -maintained. The convenience area is manned during
operating hours, and windblown litter is retrieved by facility staff as it occurs.
21. Electronics and televisions are collected on a concrete pad located on the southwest side of the convenience
area. Electronics are sorted, packaged, and palletized for transport. Loaded pallets are stored on a covered pad
next to the drop-off location. The electronics collection area was observed to be clean and well organized.
22. Scrap tire, wood waste, inert debris, white goods/scrap metal operations and a maintenance building are located
southeast of the container storage area on top of closed landfill Area 4.
23. Scrap tires are collected and stored in a large pile located West of the maintenance building. Mr. Jarboe stated
that tire trailers are loaded and transported to New River Tire. The scrap tires are stored uncovered and are
loaded into trailers provided by New River Tire. Per 15A NCAC 13B .1107(2)(c) ensure that whole and
partial scrap tires capable of holding water are covered upon receipt with a water shedding material or
disposed of, processed, or removed from the site within ten days of receipt.
24. The wood waste operations area appeared to be in good condition. Ponding water was observed on the outside
edge of the wood waste operations area. Dan Jarboe stated that the ponding water would be removed when the
ground conditions improve to allow access with machine equipment. No unacceptable waste was observed in
the wood waste storage pile.
25. The white goods collection area is located on a gravel area and was observed to be in good condition and well
organized.
26. The leachate pond appeared to be in good condition with adequate freeboard. The area surrounding the pond
was well -maintained, and the visible portion of the liner appeared to be intact.
27. Landfill side slopes were observed to be in good condition with established vegetation covering the inactive
areas. No trees or woody vegetative growth was observed at the time of the inspection.
28. The active landfill side slopes were observed to be in good condition with no evidence of erosion. Dan Jarboe
stated that seeding contracts for the side slopes would be released in the following weeks.
29. No evidence of seeps was observed during the inspection.
30. The working face was well defined and observed to be small enough to be manageable by the operators on duty.
No unacceptable materials were found in the working face.
