This site is permitted only for operations that are conducted in accordance with the representations made in the approved application, with all conditions attached to this permit, and with all of the provisions of 15A NCAC 13B.0800 -- Septage Management. Failure to operate as permitted may result in the Department suspending or revoking this permit, initiating action to enjoin the unpermitted operation, imposing administrative penalties, or invoking any other remedy as provided in Chapter 130A, Article 1, Part 2 of the North Carolina General Statutes. This facility is subjectto periodic inspection, as deemed necessary by the Division of Waste Management, to determine if the facility is in compliance with this permit. This permit is subject to review at least annually, or more often if deemed necessary by the Division of Waste Management, to determine if the operations permitted are consistent with the Septage Management Rules in effect at the time of the review. This facility shall be maintained and operated in a manner that will protect the assigned water quality standards of both surface and ground waters. 2. Leaks and spills are the responsibility of the Permittee and shall be immediately contained, cleaned up, and treated to prevent any contamination of the surrounding area. Any solids from leaks or spills shall be disposed of in a manner consistent with the NC Solid Waste Management Rules. 3. The method for controlling odors described in the approved application for this permit must effectively minimize odors created by the operation of this facilityas required by 15A NCAC 13B .0838(g). 4. Erosion and runoff control measures shall be implemented to prevent migration of soil or wastes off this facility. The installation of groundwater monitoring wells or a leak detection system may be required at the discretion of the Division of Waste Management. 5. This permit shall not affect the applicability of any statutes, rules, regulations, or ordinances that may be imposed by other local, state, or federal government agencies that may have jurisdiction over this facility. 6. This permit may be modified or reissued at any time to incorporate any conditions, limitations, and/or monitoring requirements the Division deems necessary to adequately protect the environment and public health. 7. This facility consists of one below ground 1,000-gallon concrete tank for the storage of domestic septage discharged from recreational vehicles that are not being used as permanent residences. Storage or treatment of any liquid or solid wastes other than those specified in the approved application for this permit is prohibited. 8. This facility shall only be operated under the supervision of 2853 Chimney RR, LLC staff. The Division shall be notified of any changes to this facility or its' operation prior to implementation. This facility shall be maintained to prevent the overflow of septage from the septage detention tank. The Permittee is responsible for contacting a permitted Septage Management Firm for the removal of septage from the detention tank. 10. This permit shall expire on June 16, 2024. Renewal or modification of this permit shall be in accordance with 15A NCAC 13B .0837 (n) or (q). An application for permit renewal shall be submitted at least ninety (90) days prior to the permit renewal date. 11. Records shall be maintained in accordance with the Septage Management Rules. These records shall be made availableto a representative of the Division upon request. 12. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises, or place on or related to the facility, at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the conditions of this permit; or may obtain samples of groundwater, surface water, orleachate. 13. The setbacks prescribed by 15A NCAC 13B .0838 (m) shall be maintained at all times. The Subject Parcel is currently under the Zoning Jurisdiction of Henderson County. It is zoned as Local Commercial (LC). As per Section 42-62 Table of Permitted and Special Use of the Henderson County Land Development Code, Recreational Vehicle Park is a permitted by right use within the zoned area known as Local Commercial (LC). The Subject Parcel went before the Technical Review Committee (hereafter, "TRC") on December 6, 2023, for major site plan review. The major site plan shows six (6) RV spaces, community well, and a central dump station for the occupants of the site. The major site plan showed a solid waste collection facility and for each RV space to be served by an electric and water pedestal. The TRC approved the major site plan with the following conditions: 1. Soil erosion and sedimentation control permit if disturbance is greater than 1 acre. 2. Stormwater control permit if disturbance is greater than 1 acre. 3. NCDOT driveway permit 4. Revised major site plan to show current utility easements and right-of-way. 5. Verification and approval of central dump station by NCDEQ 6. Revise major site plan to show solid waste collection facility and required screening. 7. Label total area of open space on revised major site plan.
