The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. David Powell met with Mr. Robert Knowles onsite to inspect LCID. The permit expired July 17, 2023, and the renewal was submitted a few months back. Mr. Powell investigated its status with Section Permitting and found that it’s currently being finalized. The site onsite is gated and has all-weather road access with updated
signage. Signage should also have information on what waste types are accepted, yard waste and inert debris waste for disposal, in addition to current information. Please add this information to current signage. Perimeter road is of all-weather construction as well. 15A NCAC 13B .0566 (14) - A sign shall be posted at the site entrance showing the site contact's name and phone number, the permit number, emergency contact information, and the waste types accepted for disposal at the site.

2. Cell identification signs were visible around the perimeter of cells and some traffic control markers. At the last inspection it was noted that additional EOW markers were needed, and they have been installed. Good job. The cells are considerably long from one end to the other and this will help identify each cell’s boundaries for Section staff and onsite operators. Be sure and maintain these markers moving forward.

Northern side of cell 1 and 2 with road. 3. The current working face is covered with soil, graded, and sloped 3:1 correctly. Additional soil cover was staged, and no unapproved wastes were visible during inspection. Good job.

4. Cell 2 is where the current working face is located. Cell 1 has grass established. Establish grass cover on older areas of the LCID which won’t receive waste for few months and be sure they have appropriate intermediate cover. Per rule, in part, “.0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material.”

5. Permit renewal is still being processed by DEQ and the permittee should operate according to rule, previous permit, and operations plan until new permit/operations plan submitted is approved.
