The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Mr. Powell met with Mr. Steve Waters and Ms. Ariadna Ortega, of Barnhill Contracting, to inspect the site.
Ms. Ortega will be the contact for Barnhill LCIDs with Mr. Waters retiring soon. The purpose of this site visit was to conduct a comprehensive inspection and meet Ms. Ortega. The site is gated and has all weather road access with proper signage. Road cones/barrels are used to control traffic for disposal dumping.

2. Currently has a somewhat spread-out working face, with cones/barrels to guide traffic, and within size limits. Some waste needs slightly better soil cover. Some unapproved waste was visible but minimal. Please remove to appropriate disposal site. The current access road, if maintained properly, should continue to meet the rule requirement. A perimeter access road was added around current cells, per new rules, but needs mowing. Be sure to ensure its of all-weather construction and maintained accordingly as conditions allow.
15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment. 15A NCAC 13B .0566 (7) - Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.

Unapproved wastes needing removal. 3. Cover seemed good on older areas and slopes were 3:1 ratio. Good job. Side slopes and perimeter road need mowing more frequently. The site is well maintained, but more frequent mowing is needed. Be sure to keep trees and large shrubs from growing on top and sides of the LCID in the future.

4. Areas that were previously used as working face have good cover and have been seeded. Some grasses were emerging during inspection. Good job. Maintain vegetative and soil cover, just be more frequent in mowing.

5. Edge of Waste (EOW) markers were visible, but mowing will allow them to be seen more. They should be visible from one to the other. In addition, EOW markers should be installed on the corners of the next phases 3 and 4 for reference and per rule, see comment section 6.

6. Currently, staging and processing recyclable inert materials, such as asphalt and concrete, in future phases 3, 4 and adjacent areas to the LCID. The Inert Debris storage, Treatment and Processing unit is limited to 40 tons of “CAB” (Concrete, asphalt and brick that’s clean) in these areas per permit. This unit is located at the portion of Phases 3 or 4 of the LCID landfill as shown in drawing C-1. The last approved operations plan dated February 2022 in Section 3.3 states, “It is estimated approximately 40 tons of asphalt and/or concrete will be brought to the site on an average daily basis. The temporary storage of this recovered material shall meet the requirements of
NCGS 130A-309.05(c).” The permit states the average stored at the unit will be 40 tons, and this conflicts with operations onsite. There is a larger volume of waste, and beyond the 40 tons, onsite and needs removal outside of the LCID. The phase being used is to meet pre-operational conditions as well, such as EOW markers installed etc., in order to be used for this T and P of Inert Debris. If the permittee wishes to adjust these conditions in the permit, then a discussion with Section permitting and potentially an amendment will be needed. In addition to this area and all other adjacent staging and processing of CAB, please be mindful of “130A-309.05. Regulated wastes; certain exclusions” rule. All removed metal should be recycled, and any other waste produced taken to appropriate disposal location for that waste type. Permit Attachment 3, Part VIII, (8)(a) - non-disposal waste activities at this unit shall only be permitted after the Pre-Operational Permit Condition No. 3, Part V, Attachment 2 of this permit is completely achieved and documented. The extent of the unit shall be established by physical markers. Permit Attachment 3, Part VIII, (8)(c) - On an average daily basis, approximately 40 tons of CAB will be stored at the unit.

Corrective measures are necessary as a result of this inspection and should be completed within 60 days of receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions. A follow-up inspection may be conducted shortly after this time frame.
