PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: NA OBSERVED VIOLATIONS: NA The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Staff, with the Section, visited the Yard Waste Notification (YWN) for comprehensive inspection. Renewal states, “There will be composting, the formation of windrows for leaves and glass clippings, windrows will be turned annually. Land debris, wood stumps will be loaded and hauled to county landfill. Mulch is windrows in rows 20’ x 100’ and will be turned when temperature reaches 130 degrees.” The renewal should reflect actual operations onsite at the notification, and currently it does not seem too. When submitting 2024 renewal be sure all information is correct according to onsite operations. 2. Reminder: A Yard Waste Notification is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. 3. Site was secured by gate with some fence installed at entrance onsite but is damaged. Please fix. Access road was rocked and all weather. Entrance. Mr. Powell spoke with the operator on issues identified onsite. Waste was in the center of an open area with some unapproved waste along surrounding parts of open area where people can walk past site. Site should be secure for safety and to keep unapproved wastes from entering YW area. YW in center of notification. The YW area had some standing water and has become lower than the surrounding area with the use of staging YW and then removing. Once the site has had all waste removed, and conditions allow, the notification needs to be built up with soil. Waste shall not be disposed of in water or will be in violation. Please address. Waste near standing water, area needs to be built up with soil. 6. EOW markers are suggested to be kept in place for Section staff to measure buffers and to help this site not get out of control in future. This will mark the limits of where waste can be placed. One should be visible to the other and mark up to the two-acre maximum size of the notification, while meeting the buffers for a small type 1 compost facility (rule ref. 15A NCAC 13B .1404). If the site is less than two acre, mark that size, which is the case with this site. Suggest tall white PVC pipe. One should be visible to the next. This assists with measuring buffers, so markers should represent at least appropriate buffer distances from property lines, ditches and swales etc. 7. This site also has a Temporary Disaster Debris Site (TDDS), DS26-024, at this location. The new rules, 15A NCAC 13B .0208, for TDDS were sent to City of Fay. Staff on 10/12/2021. This area was a little overgrown and should be reclaimed, meet rules, if going to be used in future. REMINDER: TDDS must be active before use by contacting Mr. Powell before waste from an emergency is collected at the site. Corrective measures are necessary as a result of this inspection and should be completed within 30 days receipt of this inspection report. Failure to meet the conditions for compliance may result in further Compliance Actions.
