Good afternoon,
We have reviewed the Post-construction/Pre-occupancy VIMS Report, North Hills Expansion – NHX, Building W (Mid-Atlantic
Associates, Inc., February 16, 2024). Based on the results provided in this report, and our assessment of the data, we are not
objecting to occupancy of this space.

Hey Claire,
Please find attached the signed and sealed report for the NHX Building W Post Construction/Pre-occupancy testing.
This report is based on the data we sent you February 2, 2024 with updates on February 7, 2024 clarifying a labeling
issue.
As discussed in the report, the data supports approval for occupancy of the building.
Building W occupancy is planned for before the end of February, so we hope to hear from you soon!

Hi Claire,
See attached chain of custody for indoor air and sub-slab samples. Our field tech had a numerical mislabel for one sub-slab
canister in the field (he also referred to each sample as SS rather than MP). The sample collected from MP-1 was labeled SS-
23 (which does not exist). The numerical and ‘SS’ error was recognized by the field tech just after the samples were shipped
to the lab. The field tech called the lab (see final page of attached field notes) to discuss the issue. The lab told the field tech
to issue a revised Chain of Custody and email it to them and they would use it for the project. When the lab report came in,
we recognized that the labeling errors were not corrected. The lab used the original Chain of Custody, not the revised one.
We resent the revised Chain of Custody to the laboratory and asked that they reissue the report to reflect the revised Chain of
Custody. The attached sub-slab chain of custody includes both the corrected ID (page 1) and the original mislabeled IDs (page
2).
It appears that when the laboratory modified the report, they did not simply change the SSs to MPs and change the label for
SS-23 to MP-1, which was all that was necessary. They changed the label from SS-19 to MP-20, the label for SS-20 to MP-21,
the label for SS-21 to MP-22 and the label for SS-23 to MP-1. We did not pick up on this because we used the original lab
report for our data analysis (since we understood the labeling error).
The Mid-Atlantic data table has the samples at the correct locations and correct labels since it was created from the original
lab report and we recognized immediately the lab had not corrected the mis-label of SS-1 as MP-23 (and SS in general). Thus,
we built the table with the correct labels. We are working with the lab to re-issue the report with the correct sample IDs. Very
sorry for all the confusion.

Claire,
Maddie will look through this an see if there has been a mix up. She will also send the chain of custody (most labs
include them with the report, but Eurofins doesn’t seem to do that).
We are aiming to get a complete sealed report out by the end of next week.

I’m reviewing the data and it looks like the sub-slab vapor data might have gotten mixed up in the table or the lab sheets. The
values from the lab data are represented in the table, but the sample locations are offset (MP-1 on the lab sheet matches the
data presented as MP-19 in the table, etc.) Please confirm the locations associated with the data provided, and please provide
the chain of custody forms for both indoor air and sub-slab data. Do you know when you might have a signed and sealed
report ready for review?

Hey Claire,
I wanted for follow up on this ‘dense’ email I sent last week on Friday afternoon at 3 pm (questionable timing, but the
last of the data came in late on Wednesday and this was the quickest I could turn it around). This is pre-occupancy
data so it is important and time sensitive. I wanted to confirm that you received it.
If you could let us know that it has been received, we would greatly appreciate it.
Thank you,
Dan

Subject: Pre-Occupancy Data For Building
W NHX (Former JC Penny's)
Claire,
We have completed the Post Construction/Pre Occupancy Sampling out at North Hills Building W. Occupancy is scheduled to
start in mid-February for the leasing office and steakhouse, both of which are on the ground floor. Residential occupancy on
the floors above the steakhouse and leasing office is scheduled for June 2024.
I am providing a data package for your review. The data package includes:
Sketch showing sample points locations and EUs
Laboratory reports for sub-slab and indoor air data
Tabulated sub-slab and indoor air data
Risk calculator output, both sub-slab and indoor air, for each EU
Indoor air samples were collected over a 24-hour period. Sub-slab soil gas data was collected five days after the indoor air
samples were collected with the VIMS fans off.
Review of the indoor air data shows evidence of impacts from indoor sources of pollutants (not surprising at new construction

sites). Additionally, laboratory MDLs for four compounds were above the IASL. To accommodate these circumstances, the
following approach/SOP was used when populating the Risk Calculator for the indoor air risk determination.
For compounds where the indoor air concentration is less than the sub-slab concentration or sub-slab MDL, the indoor
air concentration is used in the indoor air risk calculation
For compounds where the indoor air concentration is greater than the sub-slab concentration or sub-slab MDL
(suggesting an indoor air source), than 3% (the risk calculator’s residential attenuation factor) of the sub-slab
concentration or sub-slab MDL is used in the indoor air risk calculation
For compounds where the indoor air MDL is greater than the IASL, than 3% (the risk calculator’s residential attenuation
factor) of the sub-slab concentration or sub-slab MDL is used in the indoor air risk calculation (assuming this value is
also less than the indoor air MDL)
The results of the risk assessment based on sub-slab and indoor air data under the residential scenario are summarized as
follows:
Exposure Unit:EU-1 EU-2 EU-3 EU-4
Use Description:Elevator Lobby Steakhouse Stairwell Leasing Area
Sub-Slab samples:MP-1 MP-19, Duplicate (MP-19),
MP-20 MP-21 MP-22
Indoor Air Samples:IA-1 IA-19, IA-DUP (IA-19),
IA-20 IA-21 IA-22
Risk Criterion:Cancer HI Cancer HI Cancer HI Cancer HI
Use Scenarios
Residential
(Sub-Slab)4.0E-05 5.8E-01 2.3E-05 3.5E-01 2.3E-05 4.4E-01 2.2E-05 2.8E-01
Residential(Indoor Air)1.2E-05 2.3E-01 1.1E-05 8.0E-01 6.9E-06 2.0E-01 8.1E-06 1.6E-01
Evaluation of the sub-slab data also shows that risk is acceptable in all four EUs. Evaluation of the indoor air data also shows
that risk is acceptable in all four EUs. Together, these data show that occupancy of Building W is protective of public health
and operation of the depressurization fans is not necessary.
On behalf of the PD, we request occupancy approval for Building W. Please note that occupancy is scheduled for mid-
February 2024. BRS timely review of this data and occupancy acceptability determination is much appreciated.
If you have any questions, please let me know.
Thank you,
Dan
