The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Section staff met onsite to conduct a inspection of the cities YWN. Mr. Sutherland met Mr. Powell on site and unlocked the gate for access. The site has a fence and gate and is located behind the city’s wastewater treatment plant. The site was empty of YW and is used only if needed in rare conditions. Generally, all YW pickup goes
straight to landfill for disposal at 401 Sand.

2. Remember, a Yard Waste Notification (YWN) is a Small Type 1 facility. It shall have an operations area less than two acres in size and shall be limited to no more than 6,000 cubic yards’ material onsite at any given time, including finished product. Rules were readopted in late 2019 (15A NCAC 13B .1400’s rules for Small Type 1 Compost facilities (Yard Waste Notifications). A review of the new rule changes would be good for any staff dealing with the YWN. Yard waste cannot remain in the notification for disposal. If not using for approved processes, then must remove to a disposal site for that waste type. A YWN is for staging, processing and composting. Facility cannot give waste out to public without meeting requirements of 15A NCAC 13B .1406 rules. Renewal shall be submitted by June 1st of each year. It was previously requested by Mr. Powell that the 2-acre notification have EOW (edge of Waste) markers installed so that the buffers could be better checked to see if the site was used in the future. They should be on the corners and enough of them to be visible from one to the other. This will help onsite staff keep waste inside the
approved areas during its operation. Suggest tall, white PVC pipe. Photos can be sent to Mr. Powell with concrete removal documentation. The YWN should remain clear of anything being stored on it and renewal submitted every year on time if going to be used as well.

3. The site is grassed with no ruts or uneven areas. Good job. However, concrete waste that was to be removed after last visit has not been. Relevant rule for clean concrete, “130A-309.05. Regulated wastes; certain exclusions,” sent before to Mr. Sutherland. This waste has been accepted longer than the rule allows and should be disposed of immediately at a location for that waste type or crushed immediately. Given such a small amount it assumed it will be disposed of at a landfill, however, Mr. Sutherland indicated it was not clean concrete with metal embedded and should be taken to Transfer station or CDLF for disposal if metal cannot be separated beforehand. Please document disposal at the appropriate facility for your records should you need to provide that to the Section in the future or others. A time frame of 45 days from receipt of this inspection report was agreed too, that would be Thursday, March 28, 2024.

4. Corrective measures are necessary as a result of the inspection findings and shall be completed within 45 days’ receipt of this report. Failure to ensure corrective measures are complete may result in further compliance actions.
