OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0566 (4) - Areas that will not have additional wastes placed on them for three months or more, but where final termination of disposal operations has not occurred, shall be covered with no less than one foot of soil cover sloped to direct the flow of surface water from the landfill, and stabilized with vegetative ground cover or other stabilizing material. The Division may require further action to correct any condition that the Division determines may be injurious to the public health, or a nuisance to the community. (Facility Permit Attachment 3, Part V, 71 also).
Previously identified areas that needed appropriate cover have had some soil added but not enough to meet rule. All cover should be a minimum of six inches for proper depth and in intermediate areas not that will not have waste for three months or more should have at least twelve inches soil cover. Areas on the NE side of
LCID that were not eroded had waste still protruding from soil without proper soil cover. Please cover with appropriate soil, grade and slope to meet rule.

2. 15A NCAC 13B .0564 (7) The site shall establish and maintain an access road around the waste boundary for access by emergency or fire-fighting vehicles and equipment.
3. 15A NCAC 13B .0566 (7) Access roads shall be of all-weather construction and shall be maintained to allow access by vehicles transporting waste, Department staff, and fire-fighting vehicles.
Some parts of the access roads were of all-weather construction, such as the west side, and previously went
around most of the perimeter of the LCID. Repairing and maintaining existing access roads, with almost full access around perimeter, would suffice to meet rule. Previous inspection identified the need for repairs on some areas of the existing access road, specifically the south side. Since that last inspection, there has been rainfall and resulting in erosion, and which has added to the problem and now the east and south sides have become impassable.

ADDITIONAL COMMENTS
1. The purpose of this visit was to do a follow-up inspection of the Robeson County Landfills. This previous NLCID had been approved for an additional One (1) acre of LF added to the Two (2) acre, total of Three (3)
acres, notification on October 18, 2018, by the Section, due to increase demand from recent hurricanes. A PTC/PTO was issued on 3/17/2022 for continued operations in the current 3-acre section and to allow for construction of the additional 4-acre section, permitting the LCID. Construction has not begun on these additional acres. A preoperational inspection will be needed, along with other conditions met, before operations can begin in the new 4-acre section once constructed, and the LCID will total 7 acres. Discussion onsite was that expansion construction is expected soon. Signage previously noted, and was installed, has been damaged. Please repair and maintain signage as necessary. 2. The LCID working face was approaching max size and no unapproved waste was visible. Be sure all waste is covered when reaching one acre in size or monthly and please slope 3:1.
3. An attendant was onsite during inspection. EOW markers were visible around most of the LCID. Please replace any that may have been knocked down.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. Mulch has been previously used for erosion control, slope stabilization and to encourage vegetation as a top dressing. On the south slope mulch is much too deep. Max depth should be 3-4 inches. Either cover appropriately as waste or spread out the mulch for approved uses inside the limits of disposal. Some of this older mulch has been removed and is being used elsewhere on landfills but some still remains. South side cannot be accessed due to road not being all weather construction. This was also mentioned at the last inspection.
SW corner of LCID. 5. Mr. Walters and Mr. Powell discussed options for managing sites at Robeson County along with whom may be a potential contractor for expanding LCID. Mr. Walters feels there are no contractors available that will or can do the job or provide contract services to help Robeson County with their increased workload or expansion of the LCID. The County should continue efforts with addressing the issues at the landfill. 6. As a reminder, any changes to the facility or operations plan should be submitted to Section permitting for approval before they are enacted.
