The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of the visit was to inspect the CDLF for closure, view the closed MSW and the recycling area over
the closed LCID. Section staff Andrew Hammonds and David Powell met with Fort Liberty Staff, Shawn Hardy,
Jim Duncan, Dan Messier and Bryan Locklear. Site is on a U.S. military base, behind locked gate and fence with
all-weather roads. The site was visited, perimeter was toured via vehicle and visually inspected and partially
walked by all in attendance for the 1/25/2024 inspection.

2. The northeast sediment basin was still in good shape. No major erosion rills were visible, however, there was
some erosion on east side. All sedimentation and erosion control measures must be implemented and
maintained as specified in the approved plan. Some drainage features are not functioning as designed and
should be fixed as to not allow water to be impounded over cap or to keep stormwater from leaving the site
as designed. Spillway on east side needed cleaning out.

3. During inspection, there was small tree and shrubs visible along EOW needing removal. The cap of the
landfill should be mowed so, that the landfill may be properly inspected by Fort Liberty and Section staff.
Mowing should be done during optimal conditions to avoid damage to the cap system. Some EOW markers
were needed to be reinstalled or fixed around the limits of disposal as well.

4. Along the east side there was an area with settling approximately midway. Also, an area on NW corner with
standing water. Please address. Any future settled areas should be filled, regraded to meet the slope
requirements of the closure plan and seeded as conditions allow.

5. Monitoring wells inspected during inspection consisted of: GP3, MW7, MMW-9, WMW-11, SCMW-11R,
WMW-6 MW-8, MMW-8, WMW-8, SLMW-8R. MWs should be accessible by vehicle. Please be sure access
roads are accessible so that the MW’s are easily inspected by Section staff and sampling staff. MWs should
be properly locked, tagged and undamaged. Army Corp of Engineers (ACOE) does sampling/monitoring and
they have been working with Sections Ervin Lane. Mr. Powell spoke with Mr. Lane to confirm all requirements
are being met for Section in regard to sampling. MW 9 needed lock and well beside it needed to be locked.

6. Corrective measures are necessary as a result of the inspection findings and shall be completed within 30
days’ receipt of this report. Failure to ensure corrective measures are complete may result in further
compliance actions.
