As authorized by Mr. Kenneth Parker, Blue Ridge Geological Services, Inc. (Blue Ridge)
personnel performed additional services for the subject project. Per your letter dated July 5, 2023
we recorded the State-approved Notice of Residual Petroleum (NORP) at the County Register of
Deeds (copy attached). Next, we submitted public notice letters regarding the NORP and actions
performed at the subject property to the appropriate individuals. Copies of these letters as well as
certified mail receipts (green cards) for the letters are attached. As of this date, we have not
received any correspondence regarding the public notice letters for the project.
We look forward to receiving the final NFA letter. We appreciate your assistance. Please contact the

This letter is being provided to inform you that the North Carolina Department of the Environmental Quality
(NCDEQ) Division of Waste Management (DWM) has received a request for approval of a proposal to
cleanup a release from a petroleum underground storage tank system located in your area. The State rules
governing groundwater classification and standards (15A NCAC 2L .0400) require that you be informed of
the proposed activities. Blue Ridge Geological Services, on behalf of the responsible party (Kenneth and
Kevin Parker), is providing notice of the request for approval of the Initial Site Assessment Report, NORP,
and Request for No Further Action that states the following:
A 270-gallon tote of used oil was vandalized and spilled onto the ground outside the southwest corner
of the building in 2022. Approximately 38 tons of impacted soil were excavated from the area in
June 2022. One volatile organic compound and one extractable petroleum hydrocarbon fraction (C9
to C22 aromatics) was detected in several soil samples collected in the base or sidewalls of the
excavation at concentrations above the State action levels (soil-to-groundwater maximum soil
contaminant concentrations - MSCCs). No confirmation soil samples had concentrations above the
Residential or Commercial MSCCs. Groundwater was not encountered in the tank pit / soil excavation
to the termination depth of five feet below ground surface.
No additional assessment or remediation is recommended in the source area. In June 2023 a deed
restriction / Notice of Residual Petroleum (NORP) was placed on the property to avoid contact with
any remaining impacted soil at the site. We propose to use natural processes of degradation and
attenuation as a method to cleanup the remaining petroleum-impacted soil to the soil-to-groundwater
MSCCs.

Two water supply wells were located on the property near the spill. The wells were abandoned in
April 2023. No other receptors were observed at the subject site or on properties within 1,500 feet of
the source area. Based on these factors and other information presented in the report prepared for the
incident, the site was classified as Low Risk, the State issued a Notice of No Further Action (NFA)
letter for the site on July 5, 2023, and the incident was closed by the State (see attached letter).
The source area of the contamination is located at 12021 Gibson Road in Laurinburg, Scotland County,
North Carolina. Please see the attached map showing the location of the source area of the release. If you

All comments received within this time frame will be considered in approving the environmental reports
and request for No Further Action. A public meeting may be held should the NCDEQ find a significant
degree of public interest in the proposed activities. NCDEQ staff may be contacted during normal weekday
business hours to answer questions or to arrange an appointment to review the information on file pertaining
to the release. Notification of this request for approval of the environmental report, NORP, and request for
no further action is also being made by certified mail to the other adjacent property owners within or near
the source area of the release, the County Health Director, and the County Manager.

Dear Kenneth Parker:
A review of information on file with the UST Section, Division of Waste Management, Wilmington
Regional Office and the proposed Notice of Residual Petroleum declaration for a contaminant plume
located entirely on the source site, as received by this regional office on July 26, 2023, indicates that soil
and groundwater contamination meet the cleanup requirements for a low-risk release from an aboveground
storage tank (AST) or other source under Title 15A NCAC 2L .0202 and .0500, but contamination exceeds
the limits allowed for unrestricted closure of a site.
The UST Section determines the subject incident to be eligible conditionally for no further action status.
However, final approval of no further action status is contingent on the filing of the approved Notice of
Residual Petroleum (attached) with the Register of Deeds in the county in which the release is located, as
verified by the receipt of certified copies of the filed Notice of Residual Petroleum by this office; and upon
receipt of confirmation that public notice requirements have been completed, as described in the following
paragraphs.
Be advised that, as contamination may exceed the groundwater quality standards established in Title 15A
NCAC 2L .0202, groundwater within the area where contamination is present or is expected to migrate is
not suitable for use as a water supply. Be advised that as soil contamination may exceed the residential
MSCCs, the property containing the soil contamination is suitable only for industrial / commercial use as
stipulated in the Notice of Contaminated Site (attached).

As groundwater contamination may exceed the groundwater quality standards established in Title 15A
NCAC 2L .0202, and soil contamination may exceed the residential MSCCs, pursuant to NCGS 143B-
279.9 and 143B-279.11, you must file the approved plat and declaration for a Notice of Residual Petroleum
(attached) with the Register of Deeds in the county in which the release is located and submit a certified
copy to the UST Section within 30 days of receipt of this letter.
As groundwater contamination may exceed the groundwater quality standards established in Title 15A
NCAC 2L .0202, and soil contamination may exceed the lower of the residential or soil-to-groundwater
MSCCs, public notice in accordance with 15A NCAC 02L .0509(b) also is required. Thus, within 30 days
of receipt of this letter, a copy of the letter must be provided by certified mail, or by posting in a prominent
place, if certified mail is impractical, to the local health director, the chief administrative officer of each
political jurisdiction in which the contamination occurs, all property owners and occupants within or
contiguous to the area containing contamination, and all property owners and occupants within or
contiguous to the area where the contamination is expected to migrate.
Within 60 days of receiving this letter, this office must be provided with proof of receipt of the copy of the
letter or of refusal by the addressee to accept delivery of the copy of the letter or with a description of the
manner in which the letter was posted. Interested parties may examine the information on file about this
site by contacting this regional office and may submit comments on the site to the regional office at the
address or telephone number listed below.
This conditional No Further Action determination will not become valid until the UST Section
receives certified copies of the Notice of Residual Petroleum that proves it has been filed with the
Register of Deeds and until public notice requirements are completed.
