As long as “initial abatement” occurs within 90 days of release discovery you should be good. If ever
in doubt, get pre-approval anyway.

Ken:

I just wanted to let you know that I checked the water table elevation at this site,
knowing it was was probably high, and finding that it was (4-5ft bls), I conducted the
closure sampling for the UST that had the spill incident. 2 of the 8 samples were
above the action level. We will conduct soil initial abatement on the week of 9/11/23
as the UST is being removed. I have arranged a contractor to install a GWmonitoring well after we get the hole back-filled. Do you think we need any
preapproval before getting started? We are still within the 90 day window until
9/22/23. We will be following the guidelines for over excavations, so my opinion is we
do not need any preapprovals. Agree? Disagree? Comments?

I am just attempting to keep DWM informed and my client Trust Fund covered for cost
as much as is allowed.

NORR is attached. This site is unique in that all guidance, reports and NORR letters are presumed to
follow UST removal. With the known release of product from the tank this NORR is applicable.
